Buyers Beware!

How many times have you met a Realtor at a home or their office to show you homes?  Do you know that on the first meeting with a Realtor you are supposed to receive a copy of "Broker Disclosure to Customers" if you have not signed a buyer agency contract with them?  You should be asked to sign or initial this disclosure each time you meet with a different agent.  If you continue to see or use the same agent, one disclosure should be good until you purchase or for one year.

It is extremely important for you, the buyer, to understand who is represented by whom in the transaction.  The transaction is the entire buying process from looking at homes to the actual closing.

Even though this form is required, I find a lot of times, buyer's have never seen one.  If you are asked to sign one, don't panic.  This is a disclosure and NOT a contract.  Since we are required to use them, a signature or even initials on the form help us prove that we gave you a copy.

Our company stores these in alphabetical order so we are able to produce them in case of audit.  Believe it or not, real estate offices can and do have audits by the state.

Theresa--Is that form similar to the  "agency disclosure" used in MN? We are to have that signed at first substantial contact but many people who come to open and working with agents have never seen or heard of the document...I always have extras on hand at my opens :)

Yes Teri, basically the same.  Last July WI implemented this newer form called brokers disclosure to customers and incorporated the brokers disclosure to customers on the listing and buyer contracts.  Like you I have extras and so many people have never heard of them.  I do my best not to scare off buyers with it, but they don't understand why I have them and no one else they have talked to even mentions them.  Thank you for your comments, as WI and MN seem to be similar.

I took the WI licensing class a couple of years ago as my continuing ed for MN. I just never heard of this form...Never took the WI test as I figured there are so many good WI agents that it would be easier to refer the client.

No one wants to sign anything at an open do they? I do have potential clients I am working with and meeting for the first time sign the agency form as they do send out decoys to check on agents in MN. (So I have been told.) As I feel confident about the explanation that it is a disclosure, I have no problem getting the signature and not scaring away the client. It makes you appear professional as it is required by law.

You are right no one wants to sign anything at an open.  I do explain very well that it is a disclosure and not a contract.  People around here seem to be very leery that I am trying to rope them into something.  It is a shame that we as people can not trust what we hear as face value.
