I'm really not heartless. I promise I am not. But hey timing is everything.
We have a Tenant that has been behind in their rent payments and we have recently filed for a court ordered eviction. Our attorney had a special process server serve the eviction papers and he tried to reach the Tenant at their home 4 times and she keeps avoiding service. Unfortunately this isn't our first rodeo with Tenants avoiding service (some of them are starting to get really good at it), but that's a whole different blog post.
So after the 4th attempt to serve this Tenant, the special process server calls me at my office and says "I'm trying to serve her, but she won't come to the door, do you want to come meet me with a key?" I reply with an ecstatic "sure thing". It's not that I really like evicting Tenants, I just get wound up a little tight when they have been avoiding me and service. I will not let them beat me at this game!! I tell the special process server that I will call him right back.
In the 20 minutes after I hang up the phone, the delinquent Tenant comes into the office ready to make a payment on the rent. Surprise, surprise. So I have my Broker handle the situation/payment with her and I go back to my office and I call the special process server back. We want to proceed with this eviction because she is so deep in debt to us that there is no way she is catching up with $100/month payments. Luckily for me, the special process server was within 5 minutes proximity of my office. He shows up and gets the papers served to the Tenant right in front of us.
You got served.
All afternoon, I get @ replies like crazy stating that I'm "mean and heartless to do that 2 days before Christmas" and that they wouldn't want to "make me mad". Oh relax Twitterverse, I didn't evict her, I just got her served which is quite the process in and of itself. I'm still at least 6-10 days out from my court date and another 3-4 after that to actually evict her. Christmas will be long over before that day comes.
But...like I said...timing is everything.
