Remember the "do not call list" from a couple of years ago. Do you realize it still exists and the penalty is still expensive? The problem with so many of these laws is that nobody enforces the law. The law spread fear amongst the real estate community, when it was first proposed, thinking that business would come to a halt if we couldn't cold call homeowners. This added another step to prospecting however most of us just took the law in stride.

I have noticed in the last week the telemarketers are back in stride and calling under the guise of survey takers.

I was at home, minding my own business yesterday, when I received not one but two calls wanting information and then trying to sell services.

In all their wisdom the federal government left huge loopholes of who was above this law.

  1. Charities (I give to my charities, I don't need a call.)
  2. Politicians (I wonder why they exempted themselves, hmmmm?)
  3. Survey takers (Have they heard of the Internet?)

Why government thought we wanted calls from these parties, I don't know. My home phone number is unlisted and I pay extra for this service and I also pay for a warning message that makes the caller press 1 to confirm they are not a telemarketer.

I asked, yesterday, who they were calling for and found that they have machines calling random numbers, ten at a time. Whoever answers the phone first talks to the telemarketer, the other nine get a machine message that tells to them to please hold and a representative will be with you shortly. Hey I didn't call them, why should I wait for for the telemarketer?

So what do you do with a law that nobody enforces?

Agreed.  The deterrant value of a few prosecutions is lost when they are not publicized. 

What ads insult to injury for me is that they call on my 800# and I pay for the call.

I got rid of my land line a few years ago, because no one called on it.   I don't get any calls from telemarketers on my cell.  It is quite nice.

I know OF someone in California who sort of "makes a living"  suing these violators....interesting past time....and apparently a good part time income !

Paul, I went through a rash of calls for car warranties a couple of months back. Every time I received a call I went to the FTC site and reported them. After a while the calls stopped.

I read that a good percentage of DNC violations were from real estate agents and mortgage companies. At $11,000 a pop, it's not worth violating the rule. I think I'll reveiw the list before making any calls.

Lenn, That's pretty nervy calling on a 800 or toll free line. I hope you are reporting or start to report them...

Carol, I have to have land lines for my gate, fax and DSL internet connections. I did get a call from the cable company for a survey though, however that's not telemarketing. hmmm...

Michael, We had an agent, at my old brokerage, who never checked the DNC list. He would cold call 20 people a day until our managing broker got a call from a disgruntled gentlemen threatening suing. He stopped for a short period...

I ALWAYS REPORT THEM.  However, the FTC do not call rules do not support calls to businesses.
