The power of the CC: (A short sale success story)

Photo courtesy of surely As many of you know, for the past couple months my group, Short Sale and Loan Modification Nightmares, has been sending story after story to the banks about what is going on out there in the trenches, because I truly believe they don't know.

On October 1st, I put in an offer from a buyer on a property that was going to have to be a short sale. The owners lived in small town that had one of only three major businesses in town shut down and put hundreds out of work. Basically, 1/3 of all the homes in the area were put up for sale on one day.

But, the bank, despite call after call, wasn't returning phone calls, wasn't returning e-mails, and we were just having a problem with them even looking at the offer. It really was a good offer too. But, then the problem came that the foreclosure date was fast approaching and I decided to give the foreclosure department a call and advise them that we had an offer and that we would love some kind of response since it had been 3 months and I was really tired of calling everyday and getting the run-a-round.

We really needed this home to be removed from the auction block and the negotiator to return our phone calls and e-mails. Well, the foreclosure department wasn't going to do that. They said, "Sorry, the date has been set and we know your client isn't living there now." "Well of course not! There weren't any jobs available in that town since 1/3 of the work force was out of a job all on the same day."

So, since this didn't work, and I had a name in the foreclosure department and the short sale department, I thought it best that I get both of them to pay attention to each other. I e-mailed them both the sales contract signed by both the buyer and the seller, my letter asking why this was taking so long, and that if this went to auction that this is why I felt they were committing fraud against the American people. I asked them if they weren't negotiating, and their job title was being a negotiator, why were they there. (I know pretty confrontational, but I really had, had enough.)

But, the CC: was what got both of them to give me an e-mail back within 2 hours. The home was removed from the foreclosure block and the negotiator called me. Now, who did I put in that CC: line that finally got their attention? I sent a copy of this e-mail, with my clients' permission, to our state congressman.

This was what was needed. Apparently the short sale negotiators manager didn't like the overtone of the e-mail, but it got the results I wanted and may save my clients from a foreclosure. I'll update everyone when this closes, but the auction date has been postponed indefinitely.

Todd don't take this the wrong way my friend, but you've "got balls" :)  I'll be those guys were't happy campers at all, but reading this it made no sense to me why they wouldn't work with you, and get the house sold.  That CC was ingenious, it's about time the Banks were held accountable like the rest of us.

It sounds like you finally got the attention necessary.  I find that many of these negotiators are so mired in 100s 1000s of files that they just can't get unburied and sometimes moving it up a little makes a difference.

I hope for everyones' sake you are able to complete the sale.

Todd- Good for you Todd! It also works when you CC all the executives of the bank. We even had one bank's Vice President write our sellers an apology letter! We get to the top and with some we now have a really good working relationship, they tell us to call them with our files. They know we do our job, etc. and they get the fire under those front lines lit right up!

Todd, Bravo!  I have felt for sometime that Congress is who we need to be tellilng about the nightmare of the shortsales and foreclosures.  Its a nightmare for the sellers and the buyers, and I'm sure for the bank employees too, understaffed and undereducated in Real Estate.

Todd - great idea!  Even when you can find the executives names of a bank it can be near impossible to get email addresses!  The more we expose this kind of thing, hopefully the more they will feel pressure to treat people appropriately.

Way to go Todd!!  I've experienced the same frustration.  I know there have been many posts written about how we wait forever for a response and when it comes, the bank needs to close in under 2 weeks!

It is about time someone made them step up and work to meet the seller's timeframe!

Good for you, Todd, that you had the chutzpah to follow through and save this house from foreclosure. Hope it all goes well. It does make you wonder what the banks are thinking.

Christine - Squeaky wheel gets the grease right?

Doug - The banks aren't keeping anyone fiduciary responsibilities including their own.

Katerina - I did that with the president of Indy Mac and got the short sale approved, then of course three days later the federal government came in and took them over and all bets were off and we had to start all over again.

Tom - I think we have to be the champion for our clients, because the banks and the government sure aren't helping right now.

Linda - I know they don't, I would love to lay these people off for 4 months and let them feel the same pain that the people they are supposed to be helping are feeling. I think then and only then would they change their tune.

Jim - Katerina? How did you get the executives e-mails, inquiring minds what to know!

Gabe - Please feel free, this one is on the house. (No pun intended - OK, I lied, it was intended)

Gail - Feel free to join our group and tell us your horror stories so all of congress can understand what is really going on out there.

Don - I sure hope we can, the appraiser was called on Friday by the bank, so I would say that is a good sign.

Becky - If you can find a lower persons e-mail I just found out you can usually figure out the executives e-mail address. Usually has something to do with their name @ the company.

JoAnna - Please if you have stories, share them with the group so we can make this list we send to congress every week even longer.

Shirley - I was certainly running out of time and ideas, so I had to do something.

Steve - Thank you and I hope it helps you when you get that one idiot at the banks like I did.

Zilkia - I hope it helps you in the future, feel free to share it with a listing agent if you are on the buyer's side.

Pat - I promise to update everyone when and if this closes, but I think this one should close, just for the simple fact they know the home is now on the radar of someone more important than them.
