As many of you know, for the past couple months my group, Short Sale and Loan Modification Nightmares, has been sending story after story to the banks about what is going on out there in the trenches, because I truly believe they don't know.
On October 1st, I put in an offer from a buyer on a property that was going to have to be a short sale. The owners lived in small town that had one of only three major businesses in town shut down and put hundreds out of work. Basically, 1/3 of all the homes in the area were put up for sale on one day.
But, the bank, despite call after call, wasn't returning phone calls, wasn't returning e-mails, and we were just having a problem with them even looking at the offer. It really was a good offer too. But, then the problem came that the foreclosure date was fast approaching and I decided to give the foreclosure department a call and advise them that we had an offer and that we would love some kind of response since it had been 3 months and I was really tired of calling everyday and getting the run-a-round.
We really needed this home to be removed from the auction block and the negotiator to return our phone calls and e-mails. Well, the foreclosure department wasn't going to do that. They said, "Sorry, the date has been set and we know your client isn't living there now." "Well of course not! There weren't any jobs available in that town since 1/3 of the work force was out of a job all on the same day."
So, since this didn't work, and I had a name in the foreclosure department and the short sale department, I thought it best that I get both of them to pay attention to each other. I e-mailed them both the sales contract signed by both the buyer and the seller, my letter asking why this was taking so long, and that if this went to auction that this is why I felt they were committing fraud against the American people. I asked them if they weren't negotiating, and their job title was being a negotiator, why were they there. (I know pretty confrontational, but I really had, had enough.)
But, the CC: was what got both of them to give me an e-mail back within 2 hours. The home was removed from the foreclosure block and the negotiator called me. Now, who did I put in that CC: line that finally got their attention? I sent a copy of this e-mail, with my clients' permission, to our state congressman.
This was what was needed. Apparently the short sale negotiators manager didn't like the overtone of the e-mail, but it got the results I wanted and may save my clients from a foreclosure. I'll update everyone when this closes, but the auction date has been postponed indefinitely.
