***Note: 7.23.2012 - Washington Home Inspection laws/Standards of Practice state that the inspector is, "Not to advertize previous experience in associated trade as experience in the home inspection profession.  An inspector's advertized inspection experience will reflect only the inspector's experience as a home inspector and inspectors shall not advertise, market or promote their home inspection services or qualifications in a fraudulent, false, deceptive or misleading manner" (WAC 308-408C - 020 Ethics).  As such, I wish to note the following: 1) this isn't an advertizement (nor have I any knowledge as to what the home inspection statutes in the State of Washington define as "advertizing", 2) This is listed as Past Non-Inspection Background and is intended to let consumers know that I did in fact do something besides home inspections in my professional career before doing home inspections, 3) and by letting consumers know this fact and what the work was I in no way intend to explicitly or implicitly pass off this background  "... AS experience in the home inspection profession."  Furthermore, I wish to emphatically state that construction and home inspection are completely different and unrelated fields and a consumer should in no way need to hire an inspector who has worked in the construction field.  Since they are different professions, knowledge of construction as a contractor is unnecessary to be a qualified home inspector: and vice versa.  I should add, finally, that it is clearly evident by all accounts that the reason for the statute isn't to limit the rights of an individual (in this case, a home inspetor) to relate to other people what they did before becoming a home inspector.  Rather, the purpose of the statue is to prevent people from passing on their background work as work in the home inspection field.  For example: Charlie Home Inspector just started doing home inspections, but before doing home inspections was working in construction for 20 years.  Charlie's business card states that he has "20 years experience".  Charlie's statement would be an obvious violation of the statues and would be clearly fraudulent.  This is completely different from stating that Charlie has performed home inspections for two years and before that he worked as a manager at Walmart and was a superintendent at A1 Construction.  The former is clearly what the statute is after; the latter is clearly not.  The former protects consumers from fraud; the latter is an imposition on the inalliable rights that the inspector, a citizen, has to communicate information in an honest and forthwright way. As such, if you (inspector reading this) or you, Ms. Myers, wish to suggest that my mentioning my background in this manner is a violation of Washington home inspection laws then you bare the burden of proof.  Don't simply call me and tell me I have to change something "because you said so": that is simply an insufficient answer.  If the State wishes to elaborate in a nuanced fashion (e.g., "interpret the law" to state: "Yes, in fact, we are ordering home inspectors to not mention in any capacity their former work if the work is in a trade associated with homes") then I will remove this note.  Otherwise, I am confident that Ms. Myers has (vastly) more important things to do, and I am confident that you, Mr. Inspector, do as well.  That is all...  P.S.  Perhaps I should remove from my web information that I went to college?  Before you think that is taking it too far re-read the rule and how you are applying it then ask yourself if you aren't being a little broad in your application.  Don't bite off more than you can chew.  And I say this, all of it, with a smile... :-)  and the deepest of respect.  Of course.

Justin Nickelsen is a member of many nationally and locally recognized home inspection associations, including ASHI - The American Society of Home Inspectors, NACHI - The National Association of Certified Home Inspectors, WSPMA - The Washington State Pest Management Association, and is licensed with the WSDA (Washington State Department of Agriculture) as a Structural Pest Inspector. 

 Areas of Expertise
