As a listing agent I do send executed contracts to the title company and the lender.  As a buyers agent I also send executed contracts to the title company and the lender.  I don't take any chances.

I have yet to see any lender give very much credence to performing per the contract.  They have no penalty for non-performance.

I don't care who's is responsible, I do it myself to make sure they have it in a timely matter.  I do give the buyers agent 2 days and then I check to make sure the bank has it.  For my buyer, I am watching closely that the PA is followed closely

The buyers agent is not the one getting the loan.  The ONLY person that has standing in the loan is the BUYER.

The buyers agent should get all the docs to the lender and advise the buyer of their time frame for compliance...

I recommend that the sellers agent take a deep breath and read the terms of the contract.  If the buyer is in default follow the remedy that is in the contract.

The buyer is ultimately responsible for both as they are parties to the contract.

Buyer and buyer's agent. But I always check mhself to be sure this is done right away after being executed so things do not get delayed

I believe that as it's the buyer's lender, the buyer is responsible for delivering contracts to ensure a complete application. That being said, I still send all the information over "just in case." In our area the lender only needs to perform vis-a-vis our due diligence date, so I make sure that appraisals are ordered and done on time. Beyond that, it's up to the buyer to ensure lender has everything in hand to issue a loan approval per contract deadlines.

Yes, reminder to lender about all the deadlines for sure. After all, I represent the buyers best interest.

I send it no matter which side of the contract I am on if I have the contact info. I want them to get it as early as possible. They may get a duplicate but that is alright.

I agree with others.  The buyer is responsible for getting the contract to the lender and is responsible for getting the lender to perform, however, if the buyers agent wants to ensure that the contract is fulfilled on time, they will send a copy to the lender too, and ride herd to make sure all is going well.

Buyers agent but then as the LA you had better be following up for the seller. Also depends on who's fault it is:  buyer not bringing in loan app fee? lender on vacation?

Tony and Suzanne - It is typically the buyer's agent who will send the info to the buyer's lender. Now as far as who is responsible, I would have to go with Ken Jones, and say it has to be the buyer, because the buyer is on the contract, not the buyer's agent.

I can't resist.  Ultimately the "buyer" is responsible.  You guide your buyer, so you should tell them, to send it.  However, As a really good buyer agent, you should be in contact with their lender anyway and let them know a contract is on it's way.  I usually call the lender if I have not worked with them before and let them know.

it probably depends on the contract. Here it is the buyer but as a listing agent I wouldn't recommend leaving it all on the buyer.

After having a disastrous transaction because a buyer's agent wasn't ensuring the lender was performing this is a great question, so I ended up being the one to talk to their lender daily.

I always send it to the lender, and am in contact with them or ask to be cc'ed on all emails to ensure that my clients are doing what they should be. If they aren't, I step in with a friendly but firm reminder that they have a contract to adhere to.
