What I find absolutely baffling about students being sent to this community to ask questions and learn real estate is that you all are paying the instructor to teach you and the instructor is NOT teaching you.  If it were me, I would be getting a well-deserved refund and find someone that can actually teach. What a racket that instructor has going!!!

Do not confuse Seller's Agent with Selling Agent they could be different.

I am going to agree with Roy Kelley on this one.  The rules for Agency differ in different states.  Some states allow transaction brokers, other do not. Some states allow dual agency others do not.  Some states allow the Listing agent to represent the seller and allow for unrepresented buyers (and vice versa).  The agent, either buyers or sellers, is that parties representative.

One final thought do not confuse representation with commission.  In most cases when you represent at least one party you may be eligible to earn a commission.  But just because you are a someones agent does not gaurantee you a commission.

TIME OUT. The listing agent lists the property. Their job is to sell it. A buyer They can sell it themselves, by working with an agent in their company or by working with an agent in another company. A buyer agent can bring a buyer and represent thebuyer. A transactional broker can bring a buyer who represnets no one. The listing agent can get a call direct and sell the home to a buyer also being a transactional broker from the buyer and listing agent for the seller. You need to review agency.

The "Selling Agent" is anyone who is licensed, brings a valid purchase contract to the Seller to which the terms are agreed upon and acknowledged. State laws determine whether Listing  Agents can also be Selling Agents.

The listing broker this the company that lists the property and represents the seller. The selling broker is the company that sells the property and in most cases represents the buyer. In my State the seller usually pays the brokerage fee to bothe the listing and selling broker. It could also be the same company.

Unless there are other arrangements the buyer does not pay the fee. In some cases the Buyer Broker Agreement will state that the buyer pays the fee if the seller chooses not to pay it. This is an unusual situation in residential brokerage. Another example is where the buyer is asked to pay a fee above what the seller is paying. The seller is paying a $1 listing and I have made an arrangement for the buyer to pay $2. The buyer would be responsible for everything above the sellers payment.

Lastly, you can only be paid by your broker and never directly from a seller or the buyer.

Thanks alot. Im totally new to this and the study material at school does not explain who is a selling agent and listing agent. At least its not worded as seller agency. Just a description of agency relationships for commissions. Selling agent is anyone who brings a buyer to an MLS listing of a Listing agent for example. Or am i even close?
