That's a new one. I can't help wonder about the legal implications of this. If the lockbox is attached to a private property, regardless if an HOA or not, that would start with trespassing, then destruction of property, vandalism, theft of property... that calls for a police complaint and investigation into a crime. Charges and possible arrest of the culprit and the accomplices (conspiracy to commit a crime).

that lockbox would be going up someone's butt sideways..... they have no right to remove it.... they can fine the homeowner until it's removed.....

I've never heard of this happening and it has not happened to me.  Homeowners should be made awrae of any changes in the by-laws, and in turn the homeowners would let their agent know.

No, has not happened. Why not a warning first? Seems kind of drastic to just remove the lockbox; they are not cheap if you don't recover it.

I have not.  It is common for the management company to call the listing agent with a sign violation demanding the sign be removed.  Lockbox? 

If on the front door ... removing it would be pretty ballsy. If on a front gate or some other place ... not sure about that either.  

Best practice is the check the C&R's, or call / email the management company to find out what is acceptable and what is not.

yes - it was on a condo/villa and no I didn't get it back AND the management company sent a nasty letter to my owner trying to collect a $50 fine. My absentee seller was unaware of the rule and I looked up the covenants online but the management said they had notified the owner and were not responsible to provide the information to me - even though you as an agent must notify them that the property is on the market - $92 down the drain................errrgghhh

Yes & they make you come to the mgmt office to beg for your property back & the key that puts sellers security at risk. Sometimes they decide to use the sawsall to make sure it is working.

I have not had an HOA remove one but they were pretty testie about where it went and they had a limit of 30 days that a lock box or sign could be displayed Jeff Dowler

No, that has not happened to me.

I imagine that takes much more effort to remove the Surabox than to call the telephone number on the lockbox.

Not sure what I would do should that happen. My first inclination is to have some fun.

Thankfully I have not had this happen (knock on wood).  I would "go to the mattresses" as they say if they did not promptly return it.  If they had to cut the lock to remove it, I'd grab them by the ear and drag them down to the MLS to buy me a new one.  Well, either that or file a police report and every lawsuit I could find against them.  The ones Fred Griffin mentions and any unfair business practices stuff I could find.  I'd be out for blood and a new lockbox (or two).

Some locally love to cut them off. There was a suit that they have to provide  place to put them. I agree that they do not belong on the front common door, gas meters and main railing. when they dont privide areas, many times a side fence or side rail. I always put my card taped or glued to the rear

Mine never was removed/cut out, since I followed their request immediately. HOA often have these ridiculous rules about signs and their sizes, locks location, open house rules. etc.

Jeff, I must say I never have. Why would they remove a lockbox without calling an agent beforehand and giving the reason(s) for the removal. Guess that may be asking to much.

Not a LB but I have had a sign removed and tossed into a dumpster from which I retrieved it. Always a good idea to check with the HOA people re: positioning of signs and LB before running afoul of their rules.

Whoa there cowboy!  How on earth did an HOA remove a lockbox from a private home without access to it - unless somebody on staff has a key. This is not sounding good at all.  I've never run across this issue in my area and if I did it would be crossing over the line by a long shot.

I live in a neighborhood where lock boxes are not allowed by the HOA, but don't think the HOA would go so far as to remove them.  After all it is private property.  I guess they could fine the owner (seems a bit petty...but having been involved with HOA's, I have seen even pettier things done)..
