Small print needs to go ... in fact, the small print needs to be larger to drive the point home. 

Reminds me of the Big Pharma commercials that show taking the medicine to be healthy and sexy, while in the background the disclaimer is warning of horrible side effects, including DEATH. 

BUYER BEWARE !!!

And if it's a contract or agreement, remember you are liable for the fine print on BOTH SIDES, so be sure to turn it over and read the back.

100% agree if it's too small to read it should be allowed.  And no one actually reads licenses agreements besides me I don't think.

I think fine print came about because of lawsuits Richie Alan Naggar . Just like Why should a mortgage be 12 to 20 pages when it could just say if you don't pay you don't stay? They are 20 pages because a man (or woman) is no longer good for their word. Today people and corporations are both trying to wiggle out of their responsibilities.

Also note: fine print came about because of the cost of print in newspapers. When an advertiser was forced to say something they didn't want to say at X$'s per column inch why pay top advertising dollar for it?

Even if the print was larger, people will still lay claim they were coerced,  that it wasn't explained properly or there was hidden meaning in the words.

A past client claimed she didn't understand what she signed, when trying to get out of a buyer broker agreement. I went through the contract, word by word, line by line and even asked if she had any questions. Sheesh, some people!

The small print is not there to be in the favor of the consumer. It is there to limit liability of the provider to the enth degree. Gotta go so we know what we are getting.

I agree. Hardly anyone reads it. It feels like anything important would be hidden in there. I mean, how long would it take a person to read all the fine print on everything they use, every time it is updated?

Every subscribing service we use comes the miles of fine print. And they update it every six months. We as a population have become numb to the need to read the fine print and VOLUNTEER to have our personal data exploited. For example, if one does not like the TOS for using Microsoft 365, what are the real options? Or Google or Active Rain?
How about that mile long receipt at CVS or Staples?
Or the mile long ingredients label on that 'six pack' of cup cakes at Publix?
Making fine print BIG is not the answer. Seriously, "Who has time for that?"
However, the FDA, FTC can compel those who practice deception to rely ONLY on clinically significant (not merely statistical) data. Living 3 months longer in a coma is NOT providing longer life. That only transfers more wealth to the healthcare and insurance industry.
The betrayal is those in government who have allowed these transgressions. The reality is no one is looking out for the consumer. And the attorneys LOVE the outcome.

I signed a 159 page contract to purchase season tickets to Sofi Stadium the seat license.  Did I read it, no, should I have, I don't think so.  I am a believer that the state and federal government looks over such deals.  It's take it or leave it and I wanted it so I signed.

Small print is there for legal protection against [sometimes frivolous] lawsuits, kind of similar to having an E&O policy. Often the warnings are there also for the consumers, in case of allergies, etc.

Agreed.  Reminds me of the "If it doesn't sell, we'll buy your home" advertising where the small print had conditions so many requirements that had to be met that it was easy to fail and the agent had an out.

 

Or the "oops we exposed your data, here's free credit monitoring for a year" with the small print of "if you accept this you give up your right to sue us over the breach."
