The STATE ASSOCIATIONS could negotiate volume discounts for the boards in their states for forms and LBs . . why not?

The people running the NAR are destroying the Realtor brand and there's nothing we can do but watch it happen and pay our dues. As Debe said, all real estate is local and allowing individual Boards across the states to manage the industry seems the right thing to do. We buy our lockboxes from the local Board and many of our forms are state based.

In order to become a member of my local MLS service HAR (Houston Assoc. of Realtors) I had to join TAR (Texas Assoc. of Realtors) and than I had to become a member of NAR. All just to join my local MLS service - LOL...

I don't get E&O from NAR. In fact, I have no E&O. I pay an annual fee to Coldwell Banker and they provide attorney support in the event of a problem. Standard forms come from the states of NC and SC. I'm sure lockboxes can be purchased with a middle party. I won't miss not having to pay an annual fee to the NAR that doesn't seem to do much for me.

The most important thing that all levels of Realtors provides is lobbying power.
When the pandemic first started, Orange County (Orlando) issued a shutdown. Real estate was not an essential job. Within 24 hours, they published a new list and real estate was essential. That doesn't happen by itself.
Also in Florida have been strong efforts to get rent control. Florida Realtors fought it.
The lobbying component is important. If they lost their membership numbers, they would lose that power.

It would expect some form of state association maybe, but E&O is an individual/company thing and lockboxes are an MLS thing (out here). Standard forms are nice, but I suspect the forms our state provides will still be the main ones in use.

There shouldn't be a NAR - technology and communication platforms have advanced enough that state specific forms (which should be unified to be more general to encompass the same details/layout independent of state/MLS), MLS/listing access/etc should be available to a broader, perhaps nationwide community.
At this point NAR acts as gatekeepers and hurdles to industry progress more than anything else. I'd welcome their disappearance if it meant the real estate industry were modernized.

While I can't speak from experience regarding NAR - but Manhattan (and at least some of Brooklyn, Queens and the Bronx) agents rely on REBNY (Real Estate Board of NY) rather than NAR. The only agents I know of that are NAR members are because they work outside of the city where it's expected. There are pros and cons to our situation, but some of these points might not even relate to outside of my market.
Every sales deal involves buyer and seller attorney's- which significantly minimizes agent litigation risks (but of course doesn't fully eliminate risks) - and while E&O is available most agents are not using it. Standard Forms- the only standard forms we have are issued by the state and lead disclosure- everything else is the attorney's responsibility. Lockboxes - this is more for our rental market rather than our sales market. In the sales market- the listing agent (or their assignee) is almost always present for showings and the buyers agents can either register their buyers or come along for the showing. REBNY requires that all commissions are split equally unless specifically designated by the seller (which is rare other than in new construction- which sometimes favors the buyers agent).
The bigger issue is the lack of an MLS. While most listing agents post their listing to an internal brokerage feed (the closest we have to an official MLS) - not every broker is a member, so their listings don't get fed into this system. Then there is Streeteasy- a consumer facing site built specifically for NYC listings (especially breaking down co-op's, condo's, condop's, etc. as well as the true monthly costs- since co-op's include taxes in the monthly maintenance) which got bought out by Zillow more than a decade ago. Sometimes these smaller non-REBNY member brokerages will only post on Streeteasy. Then there are the suburban agents that aren't even familiar with any of the process but they have a listing from a friend or family member- and they only post on Zillow, Trulia, etc. - all of which ignores both Streeteasy and our internal broker feeds. Without a centralized MLS- listings can be anywhere and we might not know it. Realistically, Streeteasy and my internal broker feeds will have almost all of the listings with a rare few that slip through. But that still means that I am always checking at least 2 different sites to make sure I am capturing the market. The owners of Co-star have been trying to break into our market and their site has some really great features- I can't use the site since anywhere between 20-60% of listings are missing. Maybe they will work it out- but I can't invest my time and money into it unless they address the many missing listings.
Hopefully this gives you a peak inside one of the rare markets that neither the NAR nor a true MLS has penetrated.

MLS software development is old technology. Building a MLS from scratch or integrating MLS with APIs is very "doable."
Maybe if NAR folds, the kingdom is rebuilt.
Local boards have the forms and lock boxes.
State wide legal available for a fee.
E and O through your broker or State wide.
Registry with active agents who closed a transaction in the past 24 months with an internal rating and regulatory system.
Classes from all the independent companies that sell them online and the state provides annual updates of laws.
Health insurance options pooled which are cheaper.
A credit union for members
I've done a share of lobbying for mortgage and NAR lobbyists have not helped you much. NAR spends 100 million dollars annual on staff and contract lobbyists, with little results. Invariant, Aikin Gump, Capital Counsel, Crossroads, AGC go look them up and see which flag they carried up the hill.
