What?

Agents are prevented from showing a house that is listed for sale?

Shall we discuss fiduciary duties and the requirement to put the client above all?

If I was the seller of a house that was being prevented from being shown by other agents because of some stupid issue with an Association or MLS, I might have to check with my attorney as to my next step.

First of all, I would never show a home out of my area, so that's a mute point. 

Secondly, I would allow ALL showings on my listings.

... and just how does that work?  The local board cannot prevent me from showing a house in their area.  I call the agent, and arrange a showing, and the agent says "I'm sorry, but you're with XYZ board, so I won't allow you to show my property!"?

That's total B.S., and smells like a lawsuit to me.

I believe you can report them for clear cooperation.  I'm pretty sure their seller wouldn't like it either.  And I might tell them if the agent wouldn't arrange a showing. In Georgia after three attempts with the agent we are legally allowed to contact the owner.

There are way too many petty fiefdoms in the real estate industry.  Arrogant blowhards from this Board or that MLS, who think they are St. Peter at the Pearly Gates.

 

They might not give me access to their Supra eKey.  But PREVENT me from showing?   Uh-uh.

 

   The only person or party who can prevent me from showing or viewing a property is the Seller.   

 

   When I have a fiduciary with a Buyer, it is incumbent upon me to show them the property.   If necessary, I will contact the Seller directly.   That does not constitute tortious interference with a listing contract.  It is not a violation of any COE.

Our local area is surrounded by at least 3 different MLS Associations. Years ago there was no reciprocity and It was a challenge to show homes listed by the other Associations.  Our association allowed showings and the other two made it difficult with separate lockbox systems and software for both home and agent information. You could pay a one-time fee with one Association but the other one would not allow you lockbox access without full membership. It was an agent to agent phone call for each listing.

Today, it is better but still complicated to the Buyers & Sellers with multiple Associations covering their geographic area. Unfortunately , Zillow was the source that they turned too. Sometimes there were listings by all 3 on the same street and that was fun ! NOT. 

Yes, Florida is State licensing, so legally you can help anyone anywhere, but local knowledge and referrals are the way to go.

Are you asking if a realtor wants to show a house in an area but doesn't have the appropriate access technology and therefore is not allowed access, should they be able to prevent those same agents from showing their homes?

My question would be do they want to sell their own listings? If yes, why would they want to stop other agents from showing them?

I wouldn't want to be part of any limitations on showings. That's why there is always a combo box on all my listings. Anyone with a license can show. There are some associations that do not have reciprocal agreements or that use different lockbox systems. I can still show their listings if I pay the fee for the lockbox or join the association.

As I'm in the area you're discussing, there needs to be more data.  Key details are being left out.  You're on Supra, which we all use out here as well.  Furthermore, you're most likely part of CRMLS, which is also what one of the associations that covers Camarillo uses, so there shouldn't be ANY issue with access as Supra is tied to your MLS.  There are three associations that list in Camarillo, SRAR being the biggest and likely the one you're a member of.

 

If you don't want to post the details, send them to me directly.  I'm the MLS Chair and President-Elect for the Conejo Simi Moorpark association that also serves Camarillo and I can work with our CEO and the other association CEOs.

 

Aside from all that, there are already court cases which have been settled that require agents to allow agents from other associations to show homes.  That's why a lot of Valley agents have combo boxes on their listings in addition to Supras and that's also why Supra is upgrading next year to allow for agent controlled guest access.

As the broker I did not  want our agents showing property outside of their area of expertise.  Period.  Had nothing to do with MLS.  Had to do with legal issues.  As for showing one of our listings to another agent that has a good qualified buyer from another MLS - sure we would.  The LA would be sure to be at the listing while it was being showed.  That just makes sense.  Why would you not want the sellers to have an opportunity to sell?

Hi Tony! I absolutely wouldn't approve of that as I am working for the seller and owe the seller a fiduciary duty to do everything I can to sell their home. And if I was disallowed from showing one of their listings, I would remind them of THEIR fiduciary duties!

We can show and sell homes all over the state if we can gain access. If you're not part of the local board the listing agent and seller have to agree to let you show it. In the past we would get a copy of the pocket card and even call the BIC prior to giving out a code. A lot has changed and I don't know if that's good enough anymore. I would make it clear that the agent has to be here for inspections, etc. That's where the real problem comes in.
