I never disclosed this but.... wtf

In Oregon we have a 5 page disclosure for the Seller to fill out as to whats right and wrong with the house. Repairs made, with or without permits ect.. I tell them fill it out as honest as you know how.

A home inspection will verify this when the Buyers have one done. Every so often down the road the Seller will say "I didn't disclose this to you but"...WTF?

I had one recently that we got an offer and the Buyer wants the Seller to get the septic inspected and a report at Sellers expense. This is a common practice in our area. The Seller told me he "did not see a reason to mess with a system that is working". I thought it was odd. Later he mentions, "I didn't disclose this to you about the septic system, but ---- WTF.

Guess who will be looking for a new agent soon.

Bob, sellers need to get that we don't have a "Don't ask, don't tell" rule when it comes to selling a house where there are disclosure requirements.  And the main rule here is that the buyers will find out, and you will have to deal with any issues sooner or later - and the later part can be a post-settlement lawsuit!

Good morning Rob. In NJ where my license is, seller disclosure is not required by law and I didn't like them. Sometimes sellers forget and other times they just decide not to be totally forthcoming. Let the buyer rely on their inspections. Sorry about your circumstance.

That is risky for sellers but yet some still dont disclose Rob D. Shepherd . Here it is the buyer that pays for their own septic inspection.
