All tanks have to be updated and safer to the environment. The new tanks are awesome. They just about cannot leak and some even are buried with a tray or liner on the very outside chance that the tank would leak.
The EPA wants these improvements in place by 2009. It costs around $100k per tank to replace and re-fit, roughly. Many stations had this upgrade years ago, and others cannot afford it and closed shop.
