Fiduciary Duties Of A Real Estate Agent As a matter of California law, a Real Estate Broker or Agent owes the highest duty of good faith, honesty and fair dealing to their client.  This duty is referred to as the Fiduciary Duty. Many people are unaware of the fiduciary duties of a real estate agent and assume that agents who show them houses represent them. Not necessarily. If you have not signed an agency agreement that designates you as an agent's client, rather than his customer, the agent is acting as a fiduciary agent of the seller. Fiduciary duties are legal obligations to the client, not the customer. A real estate broker who becomes an agent of a seller or buyer is deemed to be a fiduciary. Other examples of fiduciaries are trustees, executors, and guardians.
As a fiduciary, a real estate broker is held by law to owe specific duties to his/her principal (the person who they are representing), in addition to duties or obligations set forth in a listing agreement, buyer representation agreement, or other contract of employment.
