Part 4
Part 5
Part 6
Part 7
Part 8
The three paragraphs that start this page are all important to understand as they impact the agreement, its breach and any damages the seller can recoup.
Paragraph 28 deals with Representations. How I usually sum sub-paragraph A up is that everything needs to be written down and signed by everyone that they agree with what is written down. Don't accept anyone's word, the seller, the buyer or either of the agents in the transaction, any brochures or promotional material or even advertising. Only what … (0 comments)

Paragraph 21 deals with Maintenance and Risk of Loss. I have actually blogged on this and a good example of this is Why you need to keep your home insured until settlement. There are three parts to this paragraph.
Sub-paragraph A states that seller will maintain the property, grounds and fixtures specifically listed in this agreement in their present condition excepting normal wear and tear. Sub-paragraph B deals with any system or appliance breaks or fails before settlement. The seller has two basic choices. 1) … (0 comments)

vandekar team: Is it worth doing? - 12/04/07 07:16 AM
This month Realtor Magazine releases its report on Cost vs Value for the nation and identifies what remodelling projects are worth doing. It covers upscale and mid range projects and discusses the actual cost and the return on the investment when selling. What comes out at the top of the list are exterior projects that add to curb value. But what about our local area compared to a national report. However, I always advise customers do not wait till you are selling to do upgrades as you never get everything back. Plan those upgrades early and get some personal benefit from … (0 comments)

vandekar team: Valley Forge National Park - 12/01/07 10:36 PM
Today we see rolling hills open spaces and some wooded areas, the Park itself is much larger than many realize. The following web site is the official Park site: http://www.nps.gov/vafo/index.htm, go here to find out news of special events, directions, hours of opening and news about construction being carried out in the park.

There is also an excellent page detailing the history of Valley Forge. What lies below is an overview. Having spent many hours walking, jogging and relaxing in the park I can wholeheartedly recommend a visit. There is a sense of history, and as you follow the walking … (4 comments)

vandekar team: Open House Sunday December 2nd in Chesterbrook at 3 Treaty Drive 2-4 PM and also December 16th...if it hasn't sold! - 12/01/07 10:32 PM

The smell of brownies wafts through the house from the eat in kitchen through the dining room to the living room with its wood burning fireplace. You can see designated Open Space from the patio off the living room. A few steps from the front door and you are on one of the many walking trails that wind throughout Chesterbrook. It is only a few minutes walk to Genuardis the local supermarket or Rita's Water Ice although today may be a little chilly and a pizza from Pizzaland more appropriate during the football game. Or maybe you want a meal … (0 comments)

vandekar team: PA Homeowners urged to apply for Property tax and rent rebates - 11/30/07 07:53 AM
I blogged about this earlier this year but just wanted to make you aware of the December 31st deadline.
The deadline to apply for a Property Tax/Rent Rebate program offering rebates to qualified seniors and residents this year is December 31st. The income limit for homeowners has more than doubled for the year to $35,000, or $15,000 for renters. Applicants need only include half of their Social Security, Supplemental Security Income or federal Railroad Retirement Tier 1 benefits when calculating eligibility. The state estimates that 200,000 residents statewide are eligible for a rebate of up to $650 on property taxes and rent … (7 comments)

vandekar team: Prayer before combat... - 11/26/07 10:27 AM

I posted this photo in our blog Iraq Diaries which are emails from our son who is currently in Iraq, but as it is buried in one of the comments I just wanted to repost just this photo as it speaks volumes about the young men who are serving in Iraq.

Jeremy, Malachi Even and Jason Mann prayed before each mission we left. Here we're joined by Steven Kaliszewski and in later days we invited another guy we saw reading a Bible. I also saw from later pictures that people were watching so it's good to bring people together before the Lord, whether … (7 comments)

REPUTATION IN my line of work is a huge issue and plays a large role in your successes and position in your platoon/team. For example, if you go to a school to train and cry, complain, or give up then the people who see it remember. Your reputation precedes you and rank, though respected, doesn't mean a thing when you're a solid, hard working individual who goes out looking for initiative.
Why am I telling you this? Well my reputation has been set as well. I have been in this Battalion for a little over 2 years and … (10 comments)

vandekar team: Soccer is a common language - 11/18/07 04:29 AM

As many of you know our son Jeremy is in Iraq. you can read his emails at Iraq Diaries. They see a lot of kids as you may have noticed from his photos. Recently Iraq did really well in an Asian soccer competition and for a brief moment it united the country as you may have seen or read on the news.
Well the kids ask Jeremy if he has any soccer balls.

So Trudy, has decided to collect soccer balls and small pumps to send them over to Jeremy to give out. Used balls are great and many people have some sitting … (9 comments)

Page 5 of the Agreement of Sale is quite simple. I always find that pages 1 thru 4 take the longest to complete, after that it moves much faster.
Paragraph 12 handles Wood Infestation inspection contingency. Obviously this can be waived or elected. If waived our usual paragraph 27 the Release is agreed upon as well.
If elected the number of days is selected again running from the execution of the contract. Paragraph A says the inspection is at the buyer's expense and will be carried … (0 comments)

Paragraph 10 headed Inspection Contingency Options is the controlling paragraph for the 4 following paragraphs. It describes the 2 options available between the buyer and seller and the possible results under these options.
Option 1 applies within the contingency period as selected and stated in paragraphs 11-15. There are three possible results of the inspections.  1) The buyer can accept the property as it is and release all parties under paragraph 27. 2) If the buyer is not satisfied with the inspections the buyer … (0 comments)

If the agreement is contingent upon inspections and/or repairs, insurability, environmental conditions etc, if these are not carried out by the times stated in the agreement it is the same as if the contingency has been waived and the Buyer accepts the property and agrees to the RELEASE stated in Paragraph 27. This is one of the duties of the Buyers agent … (0 comments)

The PA Agreement of Sale (AOS) is 10 pages long, 11 if you include the Lead-based paint hazards disclosure and inspection contingency addendum and consists of 34 paragraphs and 622 lines excluding Notices on the back of the pre-printed pages, which can take it to 17 pages.  It is continually being updated due to revisions through use and often law suits which have arisen as a result.  Each paragraph states when it was last updated. This agreement is most commonly used in resales of existing homes. Builders will often have their own contracts. Whether you are a buyer or seller it … (1 comments)

vandekar team: Home InspectionProcess - 10/19/07 12:33 AM
Part of the process of selling or buying a home is the home inspection. However, many people do not understand the purpose of the home inspection. So let's look at what it is not and what it should be whether you are a seller, a buyer or simply a homeowner.
As a buyer the home inspection is not a way to get the house at a cheaper price although negotiations may take place on what is discovered this is not the intent. The purpose of the inspection is to reveal the condition of the home, the major parts and systems within the … (0 comments)
