home improvement: Calling Joe the Plumber!

During an inspection today I was running the water in a newly remodeled bathroom. The water was backing up in the sink and when I looked under it to see what was going on this is what I found. The second picture is what a normal trap would look like. What one do you think would allow water to move through easier? I'm sure "Harry Home Owner" was real proud of his "Weekend Warrior" plumbing project after his 1hr clinic at the local Home Depot. "Honey! It's working fine. No leaks!"
