Do I have to leave the smoke alarms up in my lease house? YES!!! The Texas Property Code is very strict about this and you could be subject to civil penalties and be liable for any damages caused by not having the smoke alarms installed in the proper places. This is what the Texas Property Code says about SMOKE ALARMS: Subchapter F, Chapter 92, Property Code requires the Property to be equipped with smoke alarms in certain locations. Requests for additional installation, inspection, or repair of smoke alarms must be in writing. A. Move-Out Condition: When this lease ends, Tenant will surrender the Property in the same condition as when received, normal wear and tear excepted. Tenant will leave the Property in a clean condition free of all trash, debris, and any personal property.
