estate planning: Asset Protection Blog - 06/02/10 04:32 PM
Our Free Blog is your best source for free asset protection information.

Don't rely on your LLC for asset protection.
Don't count on a corporation ether.
Don't lose your assets, when they could be protected.

Most LLCs, partnerships, and corporations are found invalid when challenged in court.

Have you had an annual meeting every year?
Have you recorded minutes?
Have you submitted your annual paperwork?
Have you EVER co-mingled your LLC and personal funds?

A trust doesn't require any paperwork and the trustee can have complete discretion to "co-mingle" the funds however they are directed by … (1 comments)

estate planning: Asset Protection & Estate Planning - 06/02/10 10:11 AM
Asset Protection and Estate Planning are more important than most people think.  In fact, thousands of people have lost some or all of their assets because they believed their LLC would protect them.

If an individual is negligent, an LLC is NOT going to protect them; however, a trust can protect their asset from liability.

In other words, a judgment can be entered, after a car wreck, real estate closing, or other liability.  But ... if your interest in an asset is protected by trust, it may not be seized to settle a judgment.

A trust can protect … (0 comments)

Protecting your assets BEFORE the lawsuit is the only way to ensure you don’t lose them.  When a suit has been filed, it’s too late.

estate planning: Assets are more than Real Estate - 05/31/10 10:37 AM

If you think “Asset Protection” only means protecting your real estate, then you need to read this post.
Assets include much more than houses.  Your assets include cars, boats, antiques, stocks, cash and anything else you own.  If you own something, it’s an asset.
Many judgments have been settled through the seizure of assets other than real estate.  Many states have homestead laws that prevent seizure of someone’s residence, but this protection doesn’t extend to other assets and everything else can still be at risk.
Stocks, bonds, antiques, vehicles, and more can all be seized to settle a judgment – … (1 comments)

estate planning: Placing Assets in Trust without Giving up Control - 05/29/10 05:06 AM
Using a Director

Many people are concerned about giving up control of their asset by placing title into a land trust and this is a factor you must consider.  As the owner, you make all decision about the property, you sign documents and you control everything.  Using a trust, this control may be passed to another person and that may not be what you want; however, there is a way around this.

Typical trusts have Trustees who are directed by the beneficiary; however, if you remain as the beneficiary, then a court may find the trust invalid.  This is … (0 comments)

estate planning: Woman Sues Man She Killed - 05/28/10 03:51 AM
Join Our Blog for more great stories like this one and learn how to protect yourself from ridiculous lawsuits.
There are more law suits filed, every day, than there are courtrooms to hear the cases, and some of the suits are tragically backward and cost innocent people their hard earned money.
In 1992 a Colorado woman struck a man crossing the road on a snowmobile.  Tragically the man died at the scene.  The police did not charge the woman, as the rider had been drinking and turned in front of her without warning.
However, the woman sued the man's estate and … (2 comments)

Can you imagine suing your neighbor over a haircut?

Rhonda Johnson did just that in 1987.

Johnson alleged that her neighbor "willfully, intentionally and maliciously" cut her hair without her consent, in Broward Country FL civil court.

Johnson further claimed the haircut took place in the kitchen of her house while she was sitting at the table.

She sued her neighbor who said Johnson asked for the haircut. … (1 comments)

Why do people insist on posting non-related replies to a blog?
I have received responses from my blogs that ranged from selling makeup to selling oil painting services and just wonder if this is a problem that other people have.
Some responses are on target and welcomed; however, there doesn’t seem to be a way to stop the inappropriate replies from coming through.
Does anyone have any ideas?
Thanks, Greg Gardner … (2 comments)
