The Notary News is a newsletter for California notaries public, published by the Notary Public Section of the Business Programs Division of the Office of the California Secretary of State. It's a great idea, and it contains various useful information.

Hi Friends -

You can also download Free PDF forms at www.NotaryClasses.com plus Dan Jones, the owner (and a great guy) has a simple explanation of the new 2008 rules and guidelines IN PLAIN ENGLISH so everyone can get a handle on it.  They're really very simple anyhow -- I just posted the info on the Notary Education group that Laura Vestanen started here on AR.

Take care and I'm sending everyone best wishes for success in 2008!

Love, Kelly

Attention All Notaries

We posted a blog (http://activerain.com/blogsview/363602/New-Notarial-Forms-California) with links to California 2008 Notary forms on our site www.needanotary.net inside of the Notary Lounge.  These forms can be completed online and customer printed with your client information to deter fraud and save you time and are very convenient from any online connection.

We have a lot of other neat and beneficial resources for notaries.  There is no registration or membership required to use any resources in our Notary Lounge.  It is vitally important that the correct form be used, as documents without valid language will be rejected for recording if dated after Jan 1, 2008 by the County Recorder’s offices.  There are severe fines and penalties if you neglect your duty under the new changes in notary law.

A notary public who willfully states as true any material fact that he or she knows to be false shall be subject to a civil penalty not exceeding ten thousand dollars ($10,000).

Important information - I'm amazed that many lenders STILL haven't changed some of the wording on the preprinted jurats and acks they have in the docs.

Effective January 1, 2015, every certificate of acknowledgment, jurat, and proof of execution by a subscribing witness must include the following disclaimer. The disclaimer must be legible in an enclosed box at the top of the certificate above the venue statement.

A notary public or other officer completing this
certificate verifies only the identity of the
individual who signed the document to which this
certificate is attached, and not the truthfulness,
accuracy, or validity of that document.

All certificates of acknowledgment, jurats, and proofs of execution completed by a notary public must be worded exactly the same as required by California Civil Code section 1189 (certificate of acknowledgment), California Government Code section 8202 (jurat), and California Civil Code section 1195 (proof of execution by a subscribing witness certificate).
It is not acceptable to affix a notary public seal and signature to a document without the correct notarial wording.
