New Condo Oversite Law will benefit Owners and Safeguard against Unruly Condo Board Members

A new law is in the works in the Florida Legislature to return some power back to individual owners and away from the board of directors. In the past few years there have been some highly controvertial stories regarding the actions that some (not all) Condominium Association Boards have taken against Owners.

While I personally feel that a boards purpose is to look after the best interest of the collective community, I see that certain members tend to get overzealous when it comes to rule enforcement.

The new condo over site law implements several requirements:

  • Any condo association director charged with felony theft or embezzlement must be removed from office until the charges are cleared.

     

  • Condo associations must now give 30-day notice before filing a lien against a unit owner.

     

  • Unit owners may now be able to place an item on a board meeting agenda through a petition of 20 percent of owners. And, meeting minutes and any other official records must be made available within 45 miles of the condominium property.
