A term used quite often is "as is, where is". The terms and conditions of real estate auctions most always have this disclaimer. In a real estate auction event the purchaser will agree contractually to purchase the lot of real estate with any and all faults. The terms are posted prior to any auction, written and verbal announcements are made to allow any potential purchaser to be aware and understand the rules. The non-contingent contract is solid, allowing for escape only under conditions that the purchaser cannot be granted clear title.
