Things Seller's should not do after under contract.

There has been some talk about Seller's and what they need to do before closing.  Well, how about some of the things they should not do.   Here are a few things that could jeopardize the sale...

I had one client remove all the appliances when he moved out even tho they were listing in the PA.  "Well, there were none when I moved in and I had to buy them so they are mine!"

We all have clients that own something that is sentimental in value.  "My mom gave me this ceiling fan and so it does not stay."  "I understand Mrs. Seller, so you should take it down now so there is no problem later."  I had one seller take down 6 $200 ceiling fans and replace them with 6 Walmart $25 specials after the final walk thru was done the night before closing.  (At least he did replace them! ;-} )

Sellers should not chage out Bathroom and Kitchen sinks with out the Buyers approval.  (AND MY KNOWLEDGE!)

Sellers should not tear out the garage work bench that is spiked into the walls. 

Sellers should not dig up garden plants...Flowers or Vegetables after you have a PA.  (Also make arrangements with the buyer about harvesting any garden produce before you just show up and pillage)

I had a Buyers agent call screaming into the phone..."they are cutting down all the trees in the front yard!"  Because the Sellers were having trouble getting the moving truck close to the house, They cut down 4 Large maple trees along the drive way and they were still cutting.

I have seen special door knobs removed.( Not Good )

I have seen Light fixtures removed. ( Also not  good )

I even seen a Seller remove a toilet seat cover! (WHY??)

"NO, you can't take the water softener unless the buyer agrees ahead of time!"

The Worst one I have encountered was when his appraisal came in $4800 higher than the price he agreed to in the PA, He...Took down the mail box, removed a retaining wall.  Dug up all the shrubs in the front of the house and was having a 4" diameter tree removed when I received the call from the Buyer's agent when they were doing the walk through the night before our 9 am closing.  When I asked him what he was doing, he replied..."Well, the house is worth more than I got so I am making up for my loss!"

Sellers...once that PA is signed, If it's attached and not  free standing, If  it is planted in the ground, If you would be upset if the home you were buying had the same article and it DISAPPEARED, then DON'T TAKE IT!!!!!

So true. Just because it is written in the contract, it still needs to be explained in detail to the sellers. I always at listing  have a mantra of if you want it to go with you, take it down and replace it. PERIOD! Oh and when representing the buyers we like to be the last one in the house prior to the closing , then go directly and sign. Just keeps honest folks honest!

Wow. People are really amazing. Nothing surprises me anymore. I can't believe that theyw ere cutting down trees to get the moving truck in instead of making the movers carry household items out to where the truck could fit.

Wow, it's bad enough that we have to put up with this in bank-owned properties. Our locals have been known to strip appliances, light fixtures, furnaces, A/Cs, water heaters, basically anything of value. I have often wondered why the banks don't file police reports. But at least it doesn't come as a surprise on the final walk-through.

William ~ I actually had one of the agents under my Broker's License go into a house right "after" settlement and take down the draperies in the MBR which were clearly spelled out in the Agreement and matched the bedspread, etc. which had been included.  Fortunately, I was still in the office when the call came in from the Buyer's Agent.

I got her on her cell and she admitted she had just left the house, had the draperies in her car and was taking them to the Sellers!  Needless to say, she turned that car around, took them back and had a "come to Tish" meeting the next morning; by that afternoon she had a new Broker.  Unbelievable!!!

It's amazing what people will do. I don't know if they don't understand or if they do understand and do those things anyhow. I know I would be mad if someone cut down the trees before they left.

This seems to be one of those things that can rear it's head just when you see the finish line; even though I have had what I think is a clear discussion with my sellers about what is considered a fixture, what stays, etc. I go through each room at an lengthy appointment and try and ask "what about those sconces?"....It seems to unfold differently in this market when sellers are convincing themselves they are "giving the house away." Even though we have a piece of paper that documents specific exclusions, something happens along the way and something else gets excluded. It's psychological and the sellers feel justified because of "lower net proceeds"...I don't think I am setting unrealistic expectations in this market, but no one is getting the number they really want at the closing table; thus the sellers feel entitled to take more stuff out of the home.

All the stuff I wrote about were covered in the contracts and I had gone over all this with the sellers.   I have had sellers tell me..."I didn't think you were serious."  I make sure everyone knows how serious I am.

These are not funny, but I had to laugh at some.. If you've been in this business long, you will find, this job is never boring..  These thefts, are some I had not heard of.. Reminds me again, to go over this when sellers sign that offer....I had a seller take of the "special " door knocker when they left, I was not the list agent,, they said of course,,, Aunt Louise had given that to them !!! Well did they think my single lady liked having a  hole if the front door to peep out of ??????dah !!!!!!!!!

When there are exceptions in the PA then the seller can take the items.  I had a purchaser do a walkthru four days before closing.  I advised against it.  The seller took all the victorian lights in the house and the purchaser wanted me to pay for them!  I had the purchaser sign a letter that I had advised against the final walk-thru that early and was protected.  But I have never heard of someone removing a retaining wall.

Those are kinda funny stories. Kinda being the operative word. People do crazy things. It's up to us, and maybe a little common sense of their own, to keep things the way they're supposed to be.

It's amazing the things some people consider okay.  On the other hand, I had a seller who was moving cross country and a first time buyer.  The seller offered to leave all the potted plants and much of the furniture for the first time buyer after we had a signed contract.

amazing...I'm glad I have never had to deal with sellers like these.

Agents on the other hand...I once sold a Turn-key condo where both buyer and seller were out of town. Took pix at the time of contract...did walk-through for my buyers the day before closing...low and behold, all of the art work had been replaced with pieces you'd expect to find in a cheap motel...went straight to the seller's broker and lined up all the pix I took on her desk...all the art work mysteriously re-appeared the next morning...love digital cameras!

To cut down tree out side of your home - i think it doesn't matter to buyer- if still matter to buyer - than buyer must crazy.
trees and shrubs - people do planting as a hobby
and when seller sell property - he sale by sf ,location, in built house appliances , home fixture, compare house market price-
so seller must have right to take out their gardening stuff and their own furniture.
if buyer can't afford to make their own plant and buy their own furniture - than why they are even in the market ????
and honestly- new house come with our plant and tress -
thats too funny when buyer expecting above and beyond-
seller - show them wonderful home and all amenities inside the home.
seller - going through tough time through inspection-
seller- gave discount to buyer for any minor or major repairs
seller- wait for appraisal- if it comes low- seller reduce the home price
on the top why people are expecting too much from the seller side.
and buyer got tons of things in the house- doesn't make sense- to complain for little thing- just because he/ she is buyer and have a game on their side.

after inspection - when seller done repairs for you for free.

please go for closing asap - that can help agent to get their commission- to help seller for moving and even help buyer to start their new home-

minor thing- please leave it - don't do complains for minor and small things :)

and start your new home with positive mind :)
