I bought a home - WHEN can I move in?

When can a Buyer get possession of a home? The phone rang and the caller was demanding the keys to a home. With a couple of quick questions of "who was calling", it was a home buyer for a Manchester NH area Home that just went under contract. They wanted the keys to begin moving in. Hold the phone Mr. Buyer, you have not closed on the sale yet. "What do i mean" they asked. Well it seems as if they asked their buyer agent if they could move in in early. The Buyer Broker said "they didn't care, it was vacant anyway." 

 

Hold the phone. That is not how it works. I had to explain  to them they can not take possession of the home until they close. They still have a home inspection to do. They still need approval on their mortgage after all. "But we are pre-approved and do not care about the inspection" replies the buyer. My reply was they can then waive the inspection or sign an addendum removing the contingency, but their bank still has to complete the appraisal and approve the mortgage. Of course we then had to attend the closing where they the funds are dispersed and they can then take possession of the home. "Why didn't their buyer broker tell them that?" they ask. 

 

In conclusion that is the question of the day and WHY you should know that the BEST way to go about any home sale or purchase is to know that the consumer should not choose just any agent, choose the BEST agent for the job. The selling agents in your area don't prepare their buyers for what happens after contract. For one thing they should not be allowing their buyer client to be calling you. What are they thinking?

Hi Scott - It's simply unbelievable that an agent wouldn't explain at least the basics of the home buying process to their client. I assume they expect to be paid in spite of that.

Debbie Reynolds that was a point i did not write about but happy you noticed. I did ask them that and he said "he could not reach them." That about says it all and makes it believable they were not informed about what happens when, during the buying process.

Vera Gonzalez those shows do affect reality and when buyers do not know what happens, they take the advice of the TV's reality shows which are not always so real.

I felt like I was in an alternate universe today talking to a seriously deficient listing agent who wanted my buyer to close a month earlier than he had written.  I explained, "He has a lease until February and has written this offer so he will only have two months overlap."  In one ear, out the other.  Listing agent responds, "But he can have pre-settlement occupancy on ours."  DUH.

Closing and then occupancy is one of the biggest problems we face, especially when you have a real estate train of multiple closings. In Oklahoma we separate closing and occupancy. We have table funding which means once all is completed you own it at that moment but a little empathy goes a long way when the contingency for a home closing makes the next transaction ahead of you close.
