It is the time of year when our "divorce niche" phone rings most now thru January. If people are in a relationship that is not "working" the "supposed to be happy" holidays bring out the height of emotions. One more dinner with the inlaws... Putting on brave faces for relatives and children when things are less than perfect....and it becomes more emotionally than is tolerable.
Most are "first time divorces"...though we have had as many as four...and the "petitioning party" doesn't know what to expect. In southeastern Wisconsin it can take a year and a half to two to get thru the legal maze and pronounce each spouse as "single."
If conditions can be agreed to in mediation, the process can go more smoothly and faster. A misnomer is that if couples agree...the court will agree..not always the case. Sometimes one spouse will give in to conditions for the sake of having it over but it is not realy equitable.
The amount of child support in Wisconsin is set by the state and not up for ssion. However, the arguments can begin when one parent petitions for joint custody to avoid or lessen child support. A Guardian Ad Litem may be appointed by the court to monitor whether the care and placement is really "equal" or if it was a ploy not to make payments but also not to share that responsibility.
There are lots of possible twists and turns in a divorce and working with divorcing couples is best served by Real Estate agents in our opinion that have experience...and beyond that EDUCATION in dealing with couples in this unfortunate situation.
