. A number of times recently, we have heard about Realtors who were having a conference call with divorcing/divorced clients to discuss on offer or some aspect in a transaction. Agents take listings...and we realize to many agents....working with a divorcing couple does not sound like it requires any special training, skills or communication techniques.  Our training and decade of working in this niche differs with with that point of view.

   It is the time of year when our "divorce niche" phone rings most now thru January. If people are in a relationship that is not "working" the "supposed to be happy" holidays bring out the height of emotions. One more dinner with the inlaws... Putting on brave faces for relatives and children when things are less than perfect....and it becomes more emotionally than is tolerable.

. We were referred to a soon to be divorced couple as listing agents. One of the "extra" benefits you get as an agent in divorce is one transaction can mean two or three...as each former spouse makes a purchase or you refer them to another agent out of the area...such great Sellabrations !
       Then assumptions by some divorcing couples...is that everything is divided 50/50...the expenses in getting the house ready as well as the profit from the sale in a state where the house is considered community property and that scenario fits the situation.  Loan applications are nosey by nature....the Lender owns more of the house than the Buyers most of the time....and the decline of the market has made those Lending folks....a tad more cautious about how much they lend and to whom.  The ability to fog a mirror and be approved for a loan days are gone. 
    There were some "in house" mortgages who bragged that no appraisal was required before the decline of the market...uh oh....Not always an appraisal fan...but none..hmmmmm.

  As Real Estate Specialists in Divorce...we become more involved in people's lives than Realtors do in a "regular\traditional" transaction.  There is a concentrated effort throughout the process to make everyone as comfortable as possible during a very, very difficult time.  Sometimes to add to the already fragile emotions...there may be the reality of a short sale which is difficult for people under any circumstances.

      Wisconsin is a community property state. There are nine community property states, the eight others are: Arizozna, California, Idaho, Louisiana, Nevada, New Mexico , Texas and Washington.  Community property means that all marital property is owned equally...there are exceptions to that...and definitions of how and what is/is not marital property. Generally speaking, a house is purchased during the term of the marriage and falls into the "community property" 50/50 equal division category.

    Wisconsin is a marital or what is sometimes called a community property state. Nationally, there are only nine states with this status including :: Arizona, California, Idaho, Louisiana, Nevada, New Mexico, Texas and Washington and Alaska is an "opt-in community property state"  where both parties have the option to make their property community property.      As markets have recovered across the country....and as "gray divorce" (marriages with older couples) has become more common, more divorcing couples have equity in the homes that they sell.  Sometimes it is agreed before the divorce is final that the house will be sold and profit divided, sometimes equally and sometimes other arrangements are made including holding the profit in one of the lawyer's trust accounts.  We discussed that in an earlier blog.
