What is a deed restricted neighborhood?

I still run into a number of buyers who are unaware of what deed restricted and non-deed restricted neighborhoods are, so I thought I would touch on a few of the main differences.  

Deed-restricted neighborhoods and non-deed restricted neighborhoods differ in terms of the rules and limitations placed on the properties within them.

In a deed-restricted neighborhood, certain conditions and restrictions are outlined in the property’s deed or governing documents. These restrictions are usually set by the developer or homeowners’ association (HOA) and are intended to maintain a specific character or uphold certain standards within the community. Deed restrictions can include rules regarding architectural styles, property uses, landscaping, or even restrictions on certain activities or behaviors. Homeowners in these neighborhoods are legally bound to abide by these restrictions, which are typically enforced by the HOA or an appointed governing body.

On the other hand, non-deed restricted neighborhoods do not have specific limitations or rules outlined in the property deeds. Homeowners have more flexibility in terms of property use, architectural styles, landscaping, and other aspects of their homes. While there may still be local zoning regulations or building codes to follow, the restrictions in non-deed restricted neighborhoods are typically less stringent than those found in deed-restricted areas. Homeowners have more freedom to customize their properties according to their preferences.

It’s worth noting that the presence or absence of deed restrictions can impact property values, neighborhood aesthetics, and overall community cohesion. Some people prefer the uniformity and protection of property values provided by deed restrictions, while others prefer the freedom to express their individuality in non-deed restricted neighborhoods. Ultimately, the choice between the two depends on personal preferences and priorities when selecting a neighborhood.
