Eric explains the various types of clients and why so many people you help will end up just getting into trouble again and become your “walking annuities”. Also, remember to email Eric your questions so he can answer them on the next podcast at podcast@taxrepllc.com.

irs: Cash and Structuring: How Accountants Get Their Clients Sent to Prison - 08/12/18 03:56 PM
In this Episode Eric sits down with IRS Special Agent Maria Papageorgiou and discusses the crime of structuring, what it is and why so many taxpayers end up committing this crime without realizing it.  Many accountants advise their clients that when it comes to cash, it is the client’s money and they can do what they want with it (so long as it was reported).  Unfortunately that is far from the truth.  Hear directly from Maria why the IRS is so intent on focusing on this violation, and what you and your clients need to know.  Get the episode in ITunes, … (0 comments)

Episode 28 of the Tax Rep Network Podcast just hit the podcast network and it features a discussion with me and the IRS Criminal Investigation's Special Agent in Charge of the Boston Field Office, Kristina O'Connell.  The topic was, of course, how IRS Criminal Investigation uses confidential informants to build a tax case.

irs: IRS Announces the end of the Offshore Voluntary Disclosure Program - 03/14/18 05:51 AM
The focus of our practice is civil and criminal taxpayer representation, and so we wanted to make everyone aware that the IRS has announced it will begin to shut down the 2014 Offshore Voluntary Disclosure Program (OVDP). The program will close on September 28, 2018. Therefore, U.S. taxpayers with undisclosed foreign financial assets have a limited amount of time to use the OVDP before the program ends.
Background
More than 56,000 taxpayers have used one of the IRS disclosure programs since the ODDP initially launched in 2009. Those taxpayers have paid a total of $11.1 billion in back taxes, interest and penalties. … (0 comments)

irs: Ringleader of Stolen Identity Tax Refund Fraud Gets 30 Years in Prison - 03/08/18 06:39 PM
Over 8,800 Identities Stolen from the U.S. Army, Alabama State Agencies and Georgia Businesses
We focus our practice on tax matters, and I in particular on civil and criminal tax controversy issues.  I can assure those of you who have never had to go through the pain of unwinding your identity being stolen that saying its unpleasant is putting it mildly.  Therefore it was with much pleasure I read the Department of Justice's announcement today that the leader in a huge identity theft ring was sentenced to 30-years in prison!
A Phenix City, Alabama, resident was sentenced today to 30 years in … (0 comments)

irs: Legislation to Repeal the IRS’s Private Debt Collection Program - 03/03/18 03:38 AM
New Haven, Connecticut: Yesterday three senators introduced legislation that would repeal the IRS’s use of private debt collectors.
The focus of my practice is civil and criminal taxpayer representation, and the IRS's required use of private debt collectors to try and do its job has increasingly come under scrutiny.
On December 4, 2015, President Obama signed the Fixing America’s Surface Transportation (FAST) Act (Pub. L. No. 114-94) into law—the first federal law in over a decade to provide long-term funding certainty for surface transportation infrastructure planning and investment.  In addition to increased funding for transportation infrastructure the FAST Act also required the IRS to … (2 comments)

irs: Avoiding an IRS Tax Levy in New Haven, CT - 02/08/18 11:32 AM
The main focus of my practice is civil and criminal taxpayer representation.  Many taxpayers who come to see us in New Haven, CT or one of our other offices are generally frightened of having their bank acounts or wages levied by the IRS.  Inevitably the discussion turns to what can we do to avoid a levy by the IRS?
The answer is easier than you think, though often what people do not want to do.
Here are the three steps to avoid an IRS Tax Levy:
1. File any missing tax returns for the last 6 years;
2. Make your current tax payments;
3. Talk to … (1 comments)

irs: Why Parents Should File Liens Against Their Kids - 11/13/17 05:23 AM
In this week's Tax Rep Podcast I discuss why parents who lend money to their children should file a lien securing their interest.  Though most people will be offended by the topic - "But we trust little Johnnie!" - it has nothing to do with a lack of love or greed.  The lien from the friendly creditor may be what provides both protection against other creditors (includingt he IRS), and also allow the child to continue operating their business when most other creditors would move to shut them down.

irs: Look Mom No Documents!: Resolving Your Tax Problem with 1 Phone Call - 10/09/17 05:29 AM
In this week's Tax Rep Podcast I discuss the IRS agreeing to extend its pilot program of the $100,000 Streamlined Installment Agreement ("SIA").
For those of you unfamiliar with the SIA, it is an installment agreement where the taxpayer agrees to repay the IRS overtime.  But unlike a regular agreement, an SIA allows the taxpayer to just agree to the repayment number with the IRS without providing any documentation: no Form 433, no documentation on assets and income, and no attorneys fees!
The SIA was capped so that those who owe $50,000 or less and could afford to pay it over 72 months … (0 comments)

irs: How to Get Rid of a Federal Tax Lien? - 09/25/17 04:51 AM
In this week's Tax Rep Network's podcast I discuss how to get rid of a federal tax lien.
Check out the Podcast Here:
When it comes to federal tax liens, the IRS takes a very hard line.  The IRS will not remove a tax lien just because it is causing issues for the taxpayer, including credit score or other economic harm.  The reason for this is that all of its research tells the IRS that the tax lien gets the tax debt paid.
So what can be done about it?
In the podcast I review options for obtaining a lien subordination, discharging assets from the … (1 comments)

irs: New Haven, CT: Can't Sell the House with a Tax Lien? Nonsense! - 09/04/17 03:56 AM
GIven that the focus of my practice is civil and criminal tax repressentation, tax liens are something we deal with frequently.  The refrain "I would love to sell my house but there is a tax lien" is one we hear so much it makes me nuts.
The reality is this: you can absolutely sell the house.  The IRS will be more than happy to allow the house to be sold.  The only thing the IRS requires is that the seller who owes money to the government not walk away with money that the IRS should have received.
So if the taxpayer owes money … (1 comments)

For my more popular blog posts I ahve started recording podcasts for the Tax Rep podcast on ITunes.
Last week my BLOG POST discussed why taxpayers should not just file joint returns without thinking through the Tax Collection consequences of the filing.  JOint liability is no joke, and innocent spouse treatment can be a challenge to qualify for.

irs: Filing The State Tax Returns First: Podcast - 08/30/17 03:33 PM
Based on the feedback of the blog article I posted a little while ago, I have recorded a podcast walking you through why it is critical to consider filing the State tax returns first, then filing the federal returns.  As I mentioned in the Blog Post HERE, filing the state tax returns first can both help resolve the state issue and make resolving the federal tax issue that much easier.

irs: Criminal Tax in New Haven, CT: What is Tax Evasion? - 08/25/17 03:35 AM
When it comes to tax crimes in New Haven, Connecticut, New York city or elsewhere, Tax Evasion is always considered the big kahuna of tax crimes.  So what is "Tax Evasion"?
We handle civil IRS cases and criminal tax cases all over the United States, and therefore see a lot of what taxpayers do and don't do that later get them into trouble.  One thing I do notice is the confusion about what "Tax Evasion" actually is, and that most practitioners do not realize there are two forms of tax evasion: Evasion of Liability and Evasion of Collection.  More and more, the … (0 comments)
