Watch out that YOU don't get accused of stealing!

By
Real Estate Agent with Lyon Real Estate, Fair Oaks CA (Sacramento Area) DRE# 00809499

jewelsToday a fellow realtor told me about her seller's accusation that our touring Realtors stole $30K worth of her jewelery!

Ann, the realtor, was the only one with the alarm code, and was there for every showing of the Miillion dollar home.  The week the home was on tour, she hosted the home and was present for each agent's viewing, as the seller was out of town.

When the seller came home, she discovered her $30K in jewelry was missing from her sock drawer, despite Ann's warnings to remove anything of value.

"I'm SURE it was one of you Realtors", claimed the seller.  "After all, you were the only one with the alarm code".

"How about your housekeeper", asked Ann.  "She has the code, too???", as visions of her pale complexion framed by an orange jumpsuit crossed her mind.

"Oh, not her... she just filed for bankruptcy, and is having a hard time.  I've known her forever.  She would NEVER do anything like THAT.  It must have been one of YOU." (sounds like a likely candidate to me!)

Mrs. Seller was preparing her police report by having Ann give her the name of every agent who toured the home. CRAP!!! Imagine being a Realtor who simply wanted to view a listed home, then being accused of pilfering $30K in jewels!!!  Ann was freaked out, as she has an impeccable reputation which was about to be harpooned by an un-bejewelled seller.

As Ann was finishing her list of agents, Mrs. Seller called... "Oh, you are the first one I am calling.  I found my jewelry.  My housekeeper moved it from my sock drawer for safe keeping....."

So the question lingers in the dust of her jewelled accusation..... How do we protect ourselves from sellers who lose/break/loan their own things, then blame us??? I've never had it happen, but had I been on tour that day, I could have been thrown in the pokey.

Instead, I was probably shopping for the flashy trashy junk jewelery I am partial to.  "Honestly Officer.... take a look at me.  Do you REALLY think I would wear pearl and 24 carat gold filigree with THESE earrings???" Sheesh.......

I bet there is a better defense..... what do you think?

thanks fo  Flickr.com's damselfly58's photostream.... were they stolen????

Hi Sally - What a terrible position to be put in by a client. I'm glad to see that the items were located. I would be interested to know what your offices legal counsel recommended you do in the future to protect yourself and your team?

I always advise  my sellers to remove or secure valuables and all small 'pocketable' items.  A drawer is not a safe place.  There was recently an incident in my area where two people came to an open house, one acted as a decoy as the other went to the bedroom and stole a credit card and jewelry from the back of a drawer.  Thanks for reminding all of us that we need to remind sellers that they must be vigilant in securing items of value.

Sally,

Thanks for the post.  It is so pertinent and timely.  As an old "country boy", I give little thought to people stealing anything.  I'm the guy who might leave the back door unlocked when I go to bed, and I often fail to lock my car.  A few months back, someone backed a pick-up down my driveway and drove off with my air compressor.  Point being, too many homeowners are too much like me--preocupied with other things and hardly a thought of a thief.

Your blog got my attention, and that is good for my clients.

Thank you!

Very frightening experience for your fellow agent, Sally. I'm sorry to hear she (and the other agents) were accused, but glad they were also cleared.

This is why the sellers need to put away any valuables, in a safe at least or preferrably out of the house.

Unfortunately jumping to conclusions can create deep resentments that last a lifetime. . it works as well with clients and family members.

I dragged a Realtor that showed one of my listings to police interviews and accusations by my clients., . at the end. . she was innocent.

A huge lesson for me early on my career

Sally,

How Unfortunate and Unfair! And I thought the Client I had listed (who moved out of town) then called and harressed me to get her house sold, and later called and threatened me because her house had been robbed, and a Flat Screen TV taken was bad! I can't imagine.

Would you check out the website and pass it on to anyone you think might be interested: www.winahouse.biz !

Thanks ,

Connie

Congratulations on the features Sally, I love the way you write -- I think the trashy jewelry defense might get you off with good behavior!  LOL  How awful for this realtor and all who came into the house, I'm glad the jewelry was found.

HI THERE SALLY  "Wu-dn't me .. no way ... my plates clean man .. " doesn't cut it anymore!  (My husband is a policeman and he hears this stuff all day long!) Well first of all - I thought I was in a groundhog day when I saw you on the "cover" of AR twice in a row - thank goodness I came out of that one only to realize you are back at writing some terrific posts!  And I love it!  Congrats! -- Gab

Being accused at all is enough to cause some real emotional damage, not just for Ann but for all of the agents who were on the tour list.  Glad it turned out okay.

Does anyone have an opinion about this?...I told my Realtor that I was giving a lots of items away before I was going to move. I offered him a few toys to take home to his grand kids. He proceeded to take an entire box of toys, which I wasn't thrilled with, but since I offered, I let him. Anyway, while I was out of town, he decided to help himself to more items without me being there, or even asking me. I later decided to give some of the items to my friend, and noticed that they were now gone. I phoned my Realtor, and asked him what I should do if things come up missing. He asked me what was missing, and after I told him, he proceeded to tell me that HE had taken the items, since he thought I was going to give them away anyway. I was furious, and told him that what he did was without integrity, and completely unethical, and that I no longer trust him. Am I justified in feeling the way I do? What is my recourse?
