Yes! You Can Evict A Tenant For Loud Noise!

Two of the biggest complaints neighbors have about other neighbors are:  loud noise and barking dogs.

I rarely get calls about either – but every once in a while it happens.  And the big question: What can be done about it?  If you are the neighbor bothered by the noise – you don’t want the noisy neighbor to know you are complaining so you might be nervous about calling the police or the landlord. 

Tucson has a “noise and nuisance” ordinance for all kinds if things that include loud noises (parties, large gatherings, music that is excessively loud, etc., and there is also a “barking dog” ordinance.  Typically, if the police get involved on either of these issues it tends to resolve the problem, and your identity usually remains anonymous.

If YOU are a tenant and the noisy neighbor - your landlord will be called and several things can be done.  If the landlord is good, s(he) will:

Call the tenant and have a good discussion with that individual – hopefully working to find a solution to the problem.

Send a copy of their lease outlining the rules of being disruptive and let tenants know “noise” is a lease violation.

Send the tenant a written notice of complaint.

And if the warnings and notices don’t work, start the process for formal notice to correct problem or face eviction.

A great reminder to read and know what is in your lease. Unfortunately most people don't know what's in their lease until their behavior requires them to.

I just had to deal with this...Not one person in our little community welcomed our new tenants, but quite a few complained about the dogs barking...We should be able to talk things out..but when that fails, the lease speaks..Yes

Good morning, Gab.... the landlord needs to take action on this type of situation....it's not fair to the neighbors.... I'd be a wild woman if I were the landlord.....
