The agent said "she's my client... I showed her the house at my open house, so I'm procuring cause!"

The client had attended her open house, and yes, the agent had walked her through the house.  But that does not, in and of itself, create a Realtor/Client relationship... and it certainly does not create procuring cause!

When explained to the listing agent, she backed down pretty quickly... but then insisted on a 25% referral fee.  Now, you might think 25% sounds reasonable given the circumstances... until you realize SHE was the one offering to pay a 25% referral fee!

Nu-uh, not gonna happen, wouldn't be prudent.

Procuring Cause is an uninterrupted chain of events that leads to a purchase.  Procuring cause is not, as many agents believe, the agent who walked them across the threshold of the house.  I am the one who suggested that the client take a look at that house, during the open house... which is generally considered "no-man's-land".  Yes, agents use it to try to attract new buyer/clients.... and some agents will glom on to an unattached buyer.

This buyer, when the listing agent asked if she had an agent said: "Yes, I'm working with XXXX, of Coldwell Banker".  The best part is that this buyer doesn't even like that house, and will not be writing an offer on it.

There will be no referral fee, of any kind.  None, nada, zip.

You have got to be kidding me.  Why would anyone think they're the procuring cause at an open house?  Well, some people just need to be educated.  Glad your buyer is moving on to another home.

That's just ridiculous. Your clients stated upfront at the open house she had an agent.  If she knew they had an agent why did she spend so much time answering questions?  That's clearly her issue. Not yours!

I am so glad there are no open houses in my market.  One less thing to bring out the crazy in agents.

Oh Alan - it breaks my heart to hear this kind of story.  How could she never have learned this?  I can understand when a member of the public might have the misperception, but another agent?

This is the definition of insanity. It is not any easier these days and it helps to helps to have a clear understanding of who truly represents you and who is your Realtor.

Oh, I hate stories like this and am hearing them more and more often!  

I had a buyer who was already under Contract that went to an open house ("just browsing" as she said).  The agent was pushy and my client said, "I already have an agent, thank you."  The agent persisted..."Well, I can assure you that I take THE best care of my buyers and you would be no exception.  Let's talk!"  My client said, "You've got a lot to learn about sales - maybe you should go train with my agent.  Would you like her name?"  THANKFULLY my client never gave the other agent my name but, phoned me the minute the door of that house closed behind her.  Of course, she told me the other agent's name!  I had never even heard of them and they weren't the listing agent.  Being painfully pushy is not the way to go about getting business!

And demanding a referral fee or claiming procuring cause isn't either...  RIDICULOUS!

Procuring cause disputes are so pointless. When I was learning this business (back when stone tablets and chisels were used) if you wrote the offer, you were the procuring cause. Even if  there were a  "gray area" for dispute, its not worth it  unless you are willing to bet your company on it. No one sale has measured up so far.
