Here's my vent of the day!

So today is the closing of my clients home and yesterday it went crazy because I had a survey on file and disclosed anencroachment and right of way. The information has been on the listing from day one, on the SPIS, the survey was given to the buyers the day they put in the offer and the lawyer said we should not have handed it over. I was under the impression that if you had one you needed to pass the information along. Apparently that is wrong and now I'm nervous and want to just check unknown under the survey box for every property. The lawyer involved stated that everything is covered under title insurance and if they don't see it they don't have to act on it ~ is this crazy or am I wrong for being honest and letting them know that there was an encroachment on the property.  Good news is they have drawn up new papers and the sale will close today as scheduled :)
