Amazed, What are they thinking ?????

For the past few weeks I have been working with a young couple looking for their first home. Within the search criteria a new listing came up that looked good. I make an appointment to show the home and the buyers loved it. This property was vacant and showed very nice. New kitchen installed, freshly painted, new carpets and many other alterations updating the home before listing for sale. They decide to write an offer to purchase this home. I contact the listing agent to discuss basic terms the seller may require and ask for the sellers disclosure.

The description of the home reads as floolws.

New concrete sidewalk & front patio! Exterior has New siding, new gutters, new downspouts, new fascia, soffit and shutters! New Kitchen with granite counter top, Solid Wood Maple cabinets, ceramic tile floor & stainless steal appliances including built in microwave! Kitchen is Open to the spacious, bright & sunny dining room/ living room, with refinished hardwood flooring & new oversized triple window in living room! 3rd floor has refinished hardwood flooring New hall bath with ceramic tile floor & linen closet, master bedroom with good size closet and New master bath with ceramic tile floor! 2 additional nice size bedrooms! Huge family room, new carpet, new powder room, laundry area & large storage closet!Newer Central Air, Gas heater and Hot water heater! Freshly painted throughout!

I receive the sellers disclosure and see that the executors have signed the disclosure. Leaving the entire Sellers Disclosure Blank. According to the priovisions of the Real Estate Sellers Disclosure Law , the executor, adminstrator,or trustee is not required to fill out Seller's Disclosure Statement. The executor, adminstrator,or trustee is must however disclose anyknown material defects of the property.

Section 7. Of the Seller's Disclosure states as follows.

Section 7. Additions/Alterations  Have any additions, structural changes or otheralterations been made to the property during your ownership ? _____ Yes  _____ No

I contact the listing agent to ask why did the executors leave the sellers disclosure blank and not fill out any of the changes made to the property. Did the sellers have any permits, inspections for the work that was completed, who performed the work ? Licensed contractors or home owner ? Too many unanswered questions.

Listing agent responds. I did not look over the sellers disclosure. They should have mentioned the changes. I will ask them to complete a list of the changes and update the Sellers Disclosure.

This business is tough enough let alone dealing with agents that do not follow up on their listing information. How can it be that an agent will not inform their client the basics and follow up.

It is difficult for sure...but I have one I recently listed that although it is 5 years old it was only recently lived in...and not by the seller....the tenant told him everything worked...but he checked I don't know on most of the boxes.....not to dupe anyone but just because he really doesn't know....

John, the other question is why did the agent not look over what her clients were providing?  We all seem to have the same issues, lazy agents.  --Krystal

John, everyday I am set back by agents who don't read or can't communicate. In NJ, sellers disclosures are not required and yet most agents use them and never read them before making them available. My view is let the buyers do the inspections and stay away from disclosures that prompt more questions than answers.

Oh my.  I received a contract from a buyer agent last week that had the entire Third Party Financing Addedum completely blank except for the clients signatures at the bottom.  His response, "Oh, once we negotiated I would finish my paperwork???"

A-mazing!

Deborah, I agree if the owner is a landlord he would not have any or minimum knowledge of the home.

 

Justin & Krystal, Some agents are extremely lazy and do not seem to care as to how they represent their clients. Make me wonder how they can sell themselves to sellers for a listing.

Shelia, I agree. I explain to my buyers to take the information with a grain of salt. However when a home has had alterations and no explaination I want to know if the permits, inspections were obtained and who did the work. Too many homeowners out there with no clue about construction that think they can do it.

 

Paula, It ia amazing how some agents think we can get additional information if the contract is signed. When I receive a contract like that I ask the other agent for additional information, otherwise their offer is incomplete and I inform my client of the lack of paperwork. How can they expect you to present a contract without the necessary documentation.
