Your Agent Can Lose You The House, If They Don't Know-Move On

 

I have a listing that is in escrow and I'm trying very hard to save the transaction. These are first time home buyers with a seeming inexperienced agent. 

The term "door opener" comes to mind. She's a very nice person...but doesn't understand enough and it's probably going to blow this deal, when there is nothing wrong.

The new buyers got the Natural Hazard Disclosure (NHD) last week. Being new buyers, they had no idea what they were looking at and the agent really wasn't much help. She called to say they were very concerned with the findings and needed to extend the escrow by 30 days as they wanted to order the complete report before they moved on.

There was NOTHING in the NHD that would be a concern to an educated buyer or their agent. The only things checked as "yes" was disclosing that:

  1. In Southern California you have to have any new ducting for a furnace sealed and tested due to emissions. (It is)
  2. The property is within 1 mile of commercial and/or industrial zones. (yes, at the end of the street is a small commercial zone...gas station, dry cleaners etc)
  3. The property is within 1 mile of possible grazing grounds for animals. (yes, it's horse property)

Nothing of concern...and yet they are probably going to withdraw from this home. They have a friend who works for the bank who told them this was VERY bad stuff...but they read the next paragraph in the disclosure, which did not pertain to them. And the agent can't seem to handle the information I'm giving her.

I've sent a detailed email explaining the above and suggested to the agent that they talk with their broker to meet with the buyer and explain. I am also willing to sit down with them and explain, but I'm not hopeful.

It's really so important to have an agent who knows what they are doing. While I don't know all the answers, I'll get them. If your agent is willing to let you run the transaction, you probably don't have the right agent. It might cost you a great home.

I would be beyond tempted to contact the agent's broker and let him/her know what the agent does not know....

Yep sadly many transactions are derailed by inexperienced or even overly power-hungry agents.

Karen, new agents probably have not the experience to realize everyone is wanting the same finish.  You are not the enemy just because you work for the seller.

Well I do disagree with you that principles should "run" the transaction. After all the agent won't be making the mortgage payments. But I do agree that the agent has to know how to explain what documents mean. Perhaps you should reach out to that agent's broker.  After all (at least in my state) the client actually belongs to the broker.

I would certainly call the broker and ask if he or she is aware of what is going on. I make it a point to follow my agents deals and lend a hand when it is needed.

It's too bad that the other agent doesn't seem to understand the information you have given her.  Perhaps if you called her broker, she would believe the information if her own broker told her.  In any case, this agent isn't helping any of the parties involved.

There are so many idiot agents handing their buyers bad advice and  / or encouraging seemingly bad behavior, and you can't educate them all. You do what you can do, try to save the transaction, offer them solutions / choices, but in the end, they are the ones who need to pull up their pants, tuck in those private parts and get on with the transaction. Not everybody can do it. Next! there is always a NEXT.

Hi guys...sorry it's taken so long to get back to this blog. Busy week. I think we've all experienced these kinds of agents and deals. It would really help consumers to do their research before choosing an agent.

Sometimes you need to call the broker yourself to save the deal--shouldn't have to but there is always your seller to consider!  

Dont you just love it when you have to sell the house 2 or 3 times through the course of the deal just to get it closed?

Hi Karen: I understand how frustrating it is to deal with inexperienced or incompetent agents. We do our best and then move on...hopefully without losing too much sleep over it. Interesting that you have a disclosure called,  Natural Hazard Disclosure which makes sense. We don't have that in Florida though we are in Hurricane Land. (And I don't mean the team )

Great Post... it is frustrating dealing with agents who are so green and I think maybe a little scared of doing the wrong thing. Her broker should be informed and help... but she should have already asked her broker about this so that may not help... Good Luck!
