The alleged splitting of attorney fees between foreclosure mills and third-party mortgage servicing providers is the subject of yet another lawsuit brought by Alabama-based attorney, Nick Wooten. The latest case involves plaintiff, Susan Marie Harris of Pensacola, against Lender Processing Services, its subsidiary LPS Default Solutions Inc., and the Ben-Ezra & Katz law firm of Fort Lauderdale.
According to the lawsuit filed in the Northern District of Florida - Pensacola Division, LPS would use its close relationship with mortgage servicers to refer foreclosure processing business to certain law firms. Those firms, including Ben-Ezra & Katz, would pay LPS a referral fee, … (2 comments)

Plantation attorney Eve Rosen, 55, was acquitted earlier today in a Miami federal courtroom of 13 counts of bank fraud, after a jury found she did not knowingly participate in a mortgage loan scam that cost three banks $7.9 million.
From straw buyers to industry insiders, over 1,200 people have been arrested nationwide as part of "Operation Stolen Dreams," a mortgage fraud initiative of the U.S. Department of Justice reflecting the coordinated efforts of law enforcement in addressing the growing problem of crime within the mortgage industry.

While the Federal Trade Commission has cracked down on debt settlement and loan modification firms that charge upfront fees, little has been done to rein in tax resolution companies that promise to reduce IRS liabilities.  The FTC has allowed a number of these operations to continue while making a determination whether the agency has authority over them.
With the April 18th tax deadline three weeks away, tax relief companies have increased late night advertising and Internet promotions promising to settle delinquent IRS debt for pennies on the dollar.  Several of these companies are under investigation for deceptive practices.
