In reading and re-reading the new Purchase and Sale Agreement, I just want to clarify a point that was previously posted in terms of the financing contingency. There has been no change in the form regarding a Buyer losing his/her earnest money if the Buyer finds out that a property doesn't appraise. ** Either the Seller reduces the sales price to reflect the appraisal, another appraisal is obtained, the Buyer decides to pay the difference or the contract is void and the Buyer gets his/her earnest money back. I recently completed the Georgia Contracts - 2007 online course and found it to be very informative and helpful, especially since there are some major changes over years past. If you are planning on using the 2007 GAR Purchase and Sale Agreement and haven't already had coursework offered at your office, I would suggest looking into this course. The cost is $30 and you get 3 hours CE credit. One thing I was unaware of is that the 2007 GAR form is merely "suggested," and not mandatory.
