alterative dispute resolution: Lender Files Suit against Borrower for Loan Fraud - 08/16/11 04:26 AM
As a Mediator, who offers Alternatve Dispute Resolution, or mediation, I'm preparing a upcoming
mediation that involves a lender going after the borrower for loan fraud. The law suit has been filed
and I was chosen by the California Superior Court to act as a mediator.
The attorney representing the bank wants $80,000 in damages and asking for the court for punitive damages.
The borrower denies the loan fraud and states that they completed the loan application in good faith without
making false statments. The borrower provided Tax returns, financial statements and was approved
for the loan.

Real Estate Disputes come in all shapes and sizes, and the past month has been active in resolving conflicts through Alternative Dispute Resolution ADR and also known as Mediation.

The Southern California buyers thought they may like relocate to the California Mother Lode in Placer County.
The sellers accepted their offer and a deposit was placed in escrow for $15,000.
The buyers made the decision not to move and the deposit held in escrow was not going to be returned.
