A "Deed in Lieu of Foreclosure" is normally not an option to a homeowner facing foreclosure, if the homeowner has subordinate liens (2nd mortgages, or lines of credit) on their property. The reason for this is that subordinate liens can be eliminated in a judicial foreclosure sale, if the first mortgage lender forecloses on the property. Otherwise, if a first mortgage lender accepts a Deed in Lieu of Foreclosure with subordinate liens, those liens would then become the lender's liability.
