$8,000 Tax Credit Question

I recently heard on Realtor Radio that 10 states are allowing home buyers access to $8,000 prior to use as a down payment for their new home. Does anyone know what states those are?

Also, how does someone claim the tax credit? Do they have to ammend their 2008 Tax Return? Can they use it on their 2009 tax return instead?
