RE: Governor Crist's Bill Actions Today, May 26, 2010

Governor Charlie Crist signed the following bills today, May 26, 2010:

CS/CS/CS HB 713 Department of Business and Professional Regulation

The new Florida law authorizing the Florida Department of Business and Professional Regulation to issue Mold Assessors (inspectors), Mold Remediators (cleanup) and Home Inspectors a license was scheduled to be effective July 1, 2010.

Adjustments had to be made to the law for grandfathering, testing requirements and insurance requirements among other things. Glitch bill CS/CS/CS HB 713 Department of Business and Professional Regulation was passed by the legislature and signed by the governor May 26, 2010.

Home Inspectors will still have a separate license from Mold Inspectors (assessors).  The new law will not be totally enforced until July of 2011.  At that time it will take 3 to 4 weeks to qualify for a home inspector license and 3 to 4 years to qualify for a mold assessor license.

The insurance requirement for mold inspectors (assessors) has been expanded to:

"(1) A mold assessor shall maintain general liability and errors and omissions for both preliminary and post remediation mold assessment insurance coverage in an amount of at least $1 million"

Qualified professional mold inspectors will not be affected much by these requirements since they are generally certified by ACAC (CIE or CMI) and already carry the required insurance.
