Home Buying Tips in Murrieta, CA: You Must Submit An Offer.

I can't submit your offer if you don't give me one.  No matter what price you tell me you’re willing to offer… whether face-to-face during an open house, or by calling my direct mobile number… I can’t submit your offer unless you give me one in writing.

A few months ago, I listed a very nice mobile home for my client. It was clean, well maintained, and in an excellent park. The location was desirable, close to lots of shopping, with easy freeway access. After completing the CMA (comparative market analysis), the seller picked her asking price. I snapped my photos (shown here), and listed her home.

We received an offer almost immediately, for 5% below asking price. My client was thrilled and willing to accept the offer. But then I received a phone call from Janice (not her real name) who said she was interested in making an offer on the home. (Janice got my number from my sign.)  I explained we already had a very good offer in-hand, and that if she wanted to make an offer, she should move quickly. So I made arrangements to show Janice the home. She arrived on time, viewed the home, and then left.

Janice then called me later that evening and said she thought the home was perfect and was willing to offer 5% OVER asking. I confirmed that her offer price would be the highest the seller had received, but that she had to submit her offer quickly since my client was ready to accept the original offer. Janice was thrilled and said she would get back to me soon.

By the next afternoon, I still hadn’t received Janice’s offer. I left her a voicemail and sent her an email asking whether she still planned to submit an offer… but she never responded. So my client accepted the original offer and we moved forward with the transaction. One month later, escrow closed and all parties were happy… well, almost all.

After escrow closed, I received a call from Janice asking why I removed my sign from the yard. I explained that the home was sold. “But you said my offer was the highest!” she exclaimed. She then proceeded to angrily express how unprofessional I was and what a disservice I did to my seller for not accepting Janice’s higher offer. I explained to Janice that I never received her offer in writing. Furthermore, she never responded to my voicemail or email. After an uncomfortably long silence, she replied, “Oh… I didn't know I had to submit an offer in writing.” I sympathized with her for her misunderstanding, but wished her success in her continuing home search.

You'd be surprised at the number of people who don't know that their offer has to be in writing. Even after they find out that the offer needs to be in writing, I have had clients say, "Well, why don't you just call the seller. I hate to go to the trouble of signing anything if they don't like my offer." I think people who are used to buying things on Craig's list and other free sites are used to calling or emailing without a contract.

Jean: Yep, it's true. She said she thought her offer was accepted. I just have no idea why she never followed-up to complete the transaction.

Nell: I've run into the same issue with my buyer's initially not understanding an offer must be in writing. But they understand once I explain it to them. What was so surprising is that not only did she think her offer was accepted, she never followed-up to complete the transaction... like open escrow, deposit funds, schedule a closing date, etc.
