One more post for the evening ...

I was contacted for a listing presentation for a young couple who purchased a home during the hot market -- their interest rate adjusted earlier this year (their payment went from $2400 a month to $3800!!).

Any way, they've had their property listed for a couple of months -- and there has be no activity -- and they're getting frustrated -- so they called me.  I sat down with them, did my presentation, and they signed a listing agreement with me and we're good to go ...

Nope -- the other agent refused to release them from their agreement!!  This agent has done nothing -- no sign, used a photo from the listing 2 years ago, minimal property description - and no lockbox!  The only way the broker would release them was if they paid the broker $1000!! 

The sellers apparently had a very long meeting with this realtor -- and he promised to market their property -- and work for them.  If nothing else, maybe my being on the ball -- sign up, lockbox placed and ready to get their property listed and marketed in one day -- will get this realtor working for his clients!!

I'm seeing more and more realtors taking short sales - and not fully representing their clients!!  We must give our clients, our best representation -- they are counting on us to help them.  Even if we can't effectuate a short sale - if we did our best for them - they will appreciate that!

I know what you mean.. My Broker has it written into our listing contract that we promise to perform. After all it is or DUTY.. That Broker needs to be reported by that seller if they were told up front that the agent wasn't going to put up a sign, lock box etc.. I am sure they wouldn't have listed with them.. Sounds funny to me.. We see this a lot with discount realtors in our area.

This wasn't a discount broker who did this -- I'm finding agents taking these short sales who are doing full commission listings - and not doing their job to the best of their ability.  It's outrageous!!  I unfortunately the broker wouldn't release them from their agreement.  It's my philosphy, if my client is dissatisfied with my service -- I'll release them from our agreement.  It keeps me on my toes and accountable to my clients.

These non-performing agents give all agents a bad name....what is worst is that most consumers don't understand that the agent is not performing his/her duty and should be disciplined.(or even loose their license). 

It would help us all if we help consumers with their rights and let them know that they can report such poor performance and violation of duty to the real estate department.

I hear this all the time.  I don't get it.  If you have a client that doesn't want to work with you why would you not cancel the contract?!?  Are there not enough people out there that would actually want to work with you?

Sorry you didn't get the listing, but I am glad that maybe the other agent may actually help the client.  Something tells me that you will be getting that listing though!

I see lots of Realtors misrepresent themselves to clients then blame the client for the problems that arise.  I know far too many who are willing to take the listing no matter what they spend their days whining about how horrible the client is.

I think every client should have the right to fire their Realtor if they do not meet the specifics of the agreement and make reasonable effort to market the property.

Wow I can't believe they paid him.  I would put a sign in the front yard so everyone knows what a dirt bag they originally hired.

I would advise the clients to hire a lawyer to write a letter of non performance, that may get the clowns moving or run and hide.  either way the clients can then go forward.
