Conflict of Interest?  Most of my clients use my husband, Joe as a Home Inspector. 

Home Inspections in Franklin, NCBefore some of you go off, I do give them other names and express it would not hurt my feelings one bit if they do not choose Joe.

For years before I became a Realtor, I went on many, many Home Inspections with my husband and used to go to his CE classes to.  I also watched many homes being built by our Custom Home Building company and was involved in that business as well.  Over the years I learned very valuable do’s and don’ts. 

This education has become very important in what I do now.  I can say with confidence I know a lot but don’t know it all.  For that reason I am a great Buyers Agent and Listing Agent before we even get to making an offer on a home or I list one for sale.  Both Joe and I take our licenses very seriously and would never jeopardize them in any way.

A little side note:  He is known for his through inspections and listing agents cringe when they know he is coming.

That said, I have had a few Agents on the Selling side argue with me that it is a conflict of interest for Joe to do a Home Inspection for my Buyers.  I say it is not and so does The NC Home Inspector Licensure Board.  I have a call and email to NAR to see what they have to say.

Yup, sounds like a conflict of interest to me.  Frankly, a rather clear one.  Yikes!  Good luck with this one June.

Even though you both have the best intentions, if something goes wrong, you are in a bad position. Probably best to avoid working on the same transactions.

Some risk sure; however if you provide several choices I do not see a conflict of interest.

June-  im not an attorney; However I would have them signe off on a disclosure of some type stating that they are aware that  the said inspector is your husband and it was their decision to use him.

OK according to NCAR legal department it is NOT a conflict but quite the opposite.  I am doing my fiduciary duty to my buyers by offering the best Inspectors in the area.  It is not up to me, the listing agent or the sellers.  It is up to the Buyers who they want to choose and as long I am disclosing who Joe is they tell me its OK.  Buyers can use whom ever they want for any and all Due Diligent Inspections.  

He also said that too many people use or throw out that word Conflict and do not even know what it means.

June I don't think it's a conflict if it's disclosed.  I agree with Michele though, I'd have them sign something that discloses they are aware the relationship.  A CYA kind of thing!  I think if we heeded the advice of many regarding conflicts of interest, we wouldn't be able to do our jobs!
