It still amazes me that many buyers still don't understand that the New Home sales person represents the new home builder, and does not place the buyer's interest first. Since 75 percent of the business comes from Real Estate agents in my local market, who do not work for the New Home builder, the agent's commission has already been added into the price.  Plus the price is hardly ever negotiated, unless of course you have those incentives to lower your price.

Bill and Liz Spear have made a Great Point here, as to Why Buyers need their own representation. It just makes good sense, and it does not COST the buyer a cent.

So if the world were logical, you'd assume that going direct to the builder would get you a juicy discount if you skipped using a REALTOR®, wouldn't you?

And perhaps with some smaller builders, that might even be true.  If you're feeling lucky, you may try that gambit and see what happens.  But before you do, please consider the following:

  • A builder's rep works for who?  Hint:  It's NOT you!  Don't get us wrong, they'll be VERY helpful!  Their paychecks depend on their ability to get you to buy a home and pile on as many options as you can pay for!  But ultimately if there's an issue and you're dissatisfied, who's your TRUE advocate?  That's the plus of having your own representative, your REALTOR®!  We don't have any special interest in making the builder happy, we ONLY work for you!
  • Larger builders EXPECT to pay a REALTOR's® fee.  It's worked into their pricing model.  They figure about half the buyers will have an agent, and the rest will come in solo.  Knowing that, they build that payment into their cost overhead, so they don't give a discount for NOT having your own representation. 
  • The builder's rep won't tell you you're OVERPAYING for your new home!  They're NOT in the business of worrying about resale for you years down the road.  Time and again we've been asked to help someone sell their home who bought WITHOUT a REALTOR® and we realize they badly overpaid for their new home.  Or that "discount lot" that had the really good deal, was a "deal killer" years later in the resale market.  Backing up to the high tension wires, the retention pond, the corner lot with no back yard.
  • The builder's  rep isn't going to tell you some of the things your REALTOR® will.  Like "Get a home inspector!".  Of course the builder makes high quality product, but mistakes ARE made!  Having a professional come out and check things over, ESPECIALLY before the drywall goes up, just might save you some major grief later!

So it's not our intent to try to scare you, just make you aware of some of the items that need your consideration.  Since it's not costing you ANY extra to have representation, why WOULDN'T you hire a REALTOR®?

I agree on all points Jerry.  Every so often I'll talk to a prospective buyer who only wants to work with the Realtor on the sign.  Makes zero business sense.

Jerry, in our market the site agent represents "the buyer", and they tell the buyers so while they're sitting in the model home.

They usually get a flat fee from the builder from each closing for sitting site- and they're expected to be at all builder meetings and ra-ra's.

Who do they represent????

Yes, Anita. I have had buyers inform me that they only want to work with the Listing agent too. Unfortunately, Texas does not have or allow Dual agency. We have something called "Intermediary" in Texas, where there is only one Broker involved, but two different agents. One to represent the buyer and the other represents the seller. Or there may be one Broker involved, but either the seller or the buyer does not have representation. We see this often with For Sale by Owners, where the seller has no representation.

Hi Larry, I guess in Washington state, those site agents will represent the buyer. Do you have a Buyer's Rep Agreement in WA and are the Buyer's required to sign them. In Texas, we have to give all prospects something Texas calls "Information of Broker Services". This form explains seller and buyer representation, intermediary representation, and sub agency.

Sometimes, even in Texas, licensed agents will sat on the builder's site, but those agents do not work for the builder since their license is at a particular brokerage. Therefore, these agents may represent those buyers that come in without representation.
