So now we get into the actual agreement. The first item identifies the parties to the agreement and specifies three key points:
1. The parties are Independent Contractors
2. Which documents/handbooks/rules both parties agree to abide by
3. The Buyer Associate works under the control of the DESIGNATED BROKER - not the Rainmaker Team Leader
INDEPENDENT CONTRACTOR AGREEMENT AS A "BUYER ASSOCIATE"
This agreement made and entered into October 26, 2006 by and between
Marriott and Marriott, PC dba THE MARRIOTT GROUP
(TONY AND SUZANNE MARRIOTT) "Rainmaker Team Leaders",
Independent Contractors of Keller Williams Realty Professional Partners, and
>, referred to herein as "Buyer Associate",

Article 1
Buyer Associate role and responsibilities are defined by:
•· The Marriott Group Buyer Associate Agreement and Handbook
•· Keller Williams Realty Professional Partners Agreement and Handbook
•· Keller Williams Realty International Agreement
Buyer Associate is subject to rules, regulations and policies including any modifications of:
•· Keller Williams Realty Professional Partners Agreement and Handbook
•· Keller Williams Realty International Agreement
•· AZ Department of Real Estate
•· Local Boards, AAR, NAR
All parties agree to conform to and abide by all laws, regulations, and code of ethics that are binding on or applicable to real estate brokers and real estate salespersons.
This agreement does not constitute in any way a hiring by either party.
The parties hereto are and shall remain independent contractors bound by the provisions hereof.
Each Buyer Associate understands he/she is working under the control of the Designated Broker for Keller Williams Realty Professional Partners, with leadership, guidance and advice from Rainmaker Team Leaders and the Director of Associate Development (DAD).

It's critical to have language that clearly specifies that this is not an employer/employee arrangement, and the sections of the agreement that follow will document and clarify the commitments made by each party.
