Property Disclosure Statement On A New Home

When do you give a property disclosure when the home is new. Do you give it when they write the contract or do you give it when the property is complete per builder and code inspector? I could really use everyone's help on this and Does your state require a property disclosure on a new construction property

Michelle, no disclosure is required in Louisiana for new construction.

Not sure on this one but I would think that the disclosures would be difficult if the property is not built.   I do a sinkhole disclosure on the land but no disclosure on the property since it doesn't exist at contract time.  Good question, I look forward to hearing what everyone has to say.

 In New jersey we are in a full disclosure state, you need to get disclosure mainly on their knowledge on the land and surrounding area, if there is anything negative. I have had future town garbage sites to underground water contamination, where they could not build a pool, to sinks holes filled in, where 5 years later it happened again.  If you represent the buyer ask for a disclosure, if the builder balks, look deeper, go to the town for info. I have been in real estate for 25 years, one of the best things has been full disclosure, every state should have it.

Whatever your local disclosure laws might be, it's good to get everything in writing about the finished - types of flooring or carpet, finished in the bathrooms, appliances, kitchen cabinets and counters - write it all into the agreement.  Also, are there any warranties required by state law?  If not, you might want to get some language to include having the builder provide one.
