1031 Exchange, Financial Planners, Go Zone Investment questions. 

I am a sales agent with a developer who only sells to investors.  Right now we are building 1500+ homes in Bay St. Louis, MS.  Some of these homes are already built and ready to close ASAP.  Now we also have homes that are not built, but from time of contract until CO is about 120 days.  What is the time frame for 1031 exchanges? Is there ever any time when a 1031 exchange works with new construction or rental properties?  The product we offer has been generating a positive cash flow and they are appraising for much higher then what we are selling them for.  So if there are any 1031 opportunities out there I would like to try to make my product known to your customers.  Also, we pay a 4% referral fee on the sale price of the property to Realtors.  Feel free to contact me for any further information. Some of the homes we have are 4 bedrooms w/2 baths and are selling for $131,900. The others are 3 bedrooms with 2 baths and they are at $124,200 and $125,900.

Hi Mary,

The investor must identify their like-kind replacement property within 45 calendar days from the date their relinquished property (sale) closed and the must complete the acquisition of the replacement property no later than 180 calendar days from the same date.  So, they have 45 days to identify and another 135 days to close on their purchase for a total of 180 calendar days to complete their 1031 exchange. 

The properties acquired must be held for investment, so as long as the property is held for investment it would qualify whether it was new construction or not.
