Judge, Jury and Executioner - What to do when you have a problem on AR

By
Real Estate Broker/Owner with Mission Grove Realty Inc.

What to do? You have a concern, an issue or, a accusation about a member. Is posting about it something we should do?

  • Would it be better to contact a member directly outside of the public view?
  • Could calling someone a liar, thief or any other derogatory statement in a public forum be a potential problem?

Being that we do not really know the people here and those who are watching, making defamatory statements about any person here might not be a good idea and could pose a multitude of problems.

As for me, I would say that contacting a member directly would be the best bet. No one could ever claim that they have no way to contact a member directly. We all have our contact information here. Most have multiple telephone numbers, e-mail and other ways in which others can communicate with them.

I have seen many posts that have no place here. Posts that, at the very least, have changed the way I think about others on Active Rain. Accusations and name calling should be reserved for the grade school playground and not anywhere else....especially not here. From members with a 100 ranking, yes.

Could it be that ones brazen enough to be Judge, Jury and Executioner in a public forum are also the ones who anonymously abuse others on AR and drive them away?

Playing Judge, Jury and Executioner in a public forum such as this, in my opinion, is simply not the right thing to do.

Use one of the great contact features available if you have an issue. I am certain that most here would surely welcome your thoughts, suggestions or to resolve an issue that you may have with another member of the community. If you thought your neighbor had done something wrong, would you take an ad out in the local paper providing your take on the situation? I see no difference if you were to post it anywhere here.

  • Think before you post.
  • If someone has offended you, contact them.
  • If you have a better way, suggest it to them.
  • If they have lost their way...help them find it.

No one should tolerate threats, abuse or defamation in any form.

Christopher,

Nice job.  I guess I just don't read the posts with the potentially damaging words.  With vbery few exceptions, what I have come to expect from the ActiveRain community is harmony and support for one another.

This really is an incredible community, onte that I am proud to be a part of.

Now Have a Blessed Day,

Unfortunately, the jello heads that need to read and implement this post, will not.  Great post.

Christopher...

The Active Rain Real Estate Network is in the process of putting together a Code Of Ethics for the Members of Active Rain.

But you know that :)

Thank you all for your continued support:

By posting statements on the web, you are publishing to the world at large and may be liable for defamation. If a business, you may also be held liable for attempts to harm its reputation and good will and interfering with its business relations. You may think that statements you post are merely an expression of your opinion and you cannot be liable. If so, you are mistaken. Opinions are actionable if they imply that defamatory facts exist to support the statement. West v. Thomson Newspapers, 872 P.2d 999 (Utah 1994).

(Excerpt from the "First Amendment Center")

Would this apply here? I am no attorney....I am A Realtor and would think we should all consider the above. I dont know how it could play out in the event it happens to you here...or anywhere else. If anyone here practices law, your comments would be appreciated.

Chris: I agree. The members that caused the motivation for this post are pretty well respected and do not seem to appreciate the gravity of such behavior. Oh well, it is to be expected.

John: We always appreciate your comments and we enjoy the ability to interact and communicate directly with you!

TLW: Writing the code is a great start yet, those that choose to use this forum to abuse others will continue to do so. Realtors are sworn to uphold by the Realtor code of ethics and we still have issues. Removal of those that wish to harm others would be the only way to stop them.

Gary and Mary: Thanks for your comments.

I'm hoping I'm not one of the jello heads, but certainly have been impacted by the horrible accusations that occurred on AR.  It has changed the way I treat my Active Rain participation.  The only thing I would add to your post is that when one makes a public accusation that has been determined to be without any proof, the accusing party should own up to the false accusation and take responsibility for harming another.  I'm not going to name names, but the one who made the accusation was not the injured party or any part of the solution.  There was more harm done by that person than in the original warning posted by the victim of harassment.   Personal accountability is a huge sign of professionalism in my book and it has not been demonstrated in this situation.

We have all been effected by accusations on AR. Especially those made without proof and based on rumor.  Unfortunately, they have impacted the way a number of very good and well established bloggers now participate in this community.

You are right, contacting someone to talk it out is the first step any of should take, not pushing the 'post' button
