Mice in the House – Any Remedy against the Seller?

Question:

As it turns out my client has an "infestation" of mice. It will cost $3000 to get them out through a pest control company.

The Home inspector didn't recall any mice in the attic, athough there were a few droppings (there are traps there now by previous seller that weren't there at inspection)

The Buyers want to be compensated by the Seller or they are considering taking legal action.

Answer:

This is not good and it is quite upsetting However, unless there was something specific in the Agreement of Purchase and Sale, there is likely nothing that can be done.

There is no legal remedy of any kind. This is simply ordinary cleanliness. So, the purchaser is expected to clean up.
