Why wait 2-3 days to send back your disclosures back after you know you are past the DUE DATE  | My uber Pet Peevelauren selinsky pet peeve of real estate brokers

I am not sure why Agents/Brokers/Realtors/ Transaction Coordinators wait 2-3 days extra on their calendar to send back disclosures and or a missing signature(s). Help! Get your files in order and emails so we can get our disclosures back in a timely manner. Communication is important through a transaction and I am going on my 27th year in the business and this task never goes away for files and it is always an issue to receive back from responsible parties for signature and disclosures.lauren selinsky real estate broker pet peeve

We have file folders and although we are digital for the most part. We have a checklist on our folders to be sure it is all done. Nothing like visual, written, and verbal to get it all done, but I constantly have the same problem from Realtors/Brokers in getting their signatures. It is pretty easy to check off your list if you need to. Nowadays ,with technology at our fingertips, you can now request a digital signature on your smart phone people! You just go online as we do in California, winformsonline and you can assign digital signatures after you create your form.

So, what is the hold up?

Why is it a problem???

What is the excuse now? besides waiting at the last minute because you could not get wifi or you had Internet issues. Enough! You had 7-10 days for disclosures to be signs and YES we gave you the weekend. That is more then enough. After all, as a listing agent. We had them complete two days after our listing and in some cases, the night of...

It is these agents that make me say, "Bartender, make it a double!" Just saying.... Now, go get your disclosures signed!

I now send all parties a spreadsheet with the dates for the transaction so we are all on the same sheet, sorry for the pun, so far it helps.

Lauren,  I do not understand it either.  I called a TC the other day on disclosures ... she said, Oh, I usually wait and send a bunch of documents together for signature.  Well that sounds efficient ... the return of the documents is due.  So much time is spend chasing down others to do their job!

Wow, in IL you'd have a voided contract. They have to come with the contract & it's not considered accepted without the buyers signing those. Maybe you should make that a law?

Some people are terrible at paperwork, but it's no excuse.  It's frustrating having to chase documents and waste time when they ought to be just sent during appropriate time frames.  Sigh...-Kasey

It is part of our contract (legal) to have signed within 7 days designated or otherwise noted in the contract. You have the option to change the date (__) in section 14a. of our contract in CA. I have no problem giving a notice to perform.

Kathleen, I know what you mean! Why not send off and check off as you go. It is simple. Everyone acts like it is so complicated to follow what is needed. Especially, our 7 days! It goes quite quickly.

Nice to have a spreadsheet Nick & Trudy Vandekar, 610-203-4543, we have a transaction file on our MLS dashboard that send everything we have uploaded for signatures to the Buying agent when we have a listing and it is a great program for those agents that cannot stay organized. They just do not take advantage of resources we have.

Kat Palmiotti I was surprised to read that. We have it listed in our contract section 14a. and in 14b. our Buyers have 14 days to complete inspections. Otherwise, notice to perform is written up.

Nina, I feel like that is putting the cart before the horse. That is a confident give me the house ;)

In CA the Listing agent provides the disclosures and sent in my office the day after the offer was accepted. How is there in NC?

In our the custom is all disclosured are reviewed and signed at the time of making an offer. From realtor standpoint the paperwork is done when an offer is made.

Our California purchase contract requires delivery of disclosures within 7 days, Laura, but it does not require signature within 7 days, and therein lies the problem. Buyers are required by contract default to return disclosures within 17 days. When they don't, the usual way to handle it is to issue a NTBP. But if they don't, what are ya gonna do? Cancel them? Beat them over the head with a broom?

One thing most agents do not realize is you cannot let a buyer sign a disclosure or addendum after closing. Once it's closed, you can't fix it.

This is why I use a TC.

Sam Shueh I like to get disclosures signed by my Seller when I list the property. That way all we do is have ready to forward when we get an offer.
