I was reading last week where some Stagers had their online photos stolen.  It disgusts me that someone would be so unprofessional, but then again I have heard stories of Stagers' advertising materials being replaced in their Staged Homes.  Who'd a thunk it?  Some people have no bounds.

After a quick visit to the Library of Congress Copyright Office, I downloaded the document: Copyright Basics.  To protect my own hide, I am merely going to point you in the right direction here.  Please click the link and read the short PDF file - it is only 12 pages long.

I will however post a couple of quotes from this document, so you will have an idea that it is quite simple to Copyright your photos, blogs, websites, podcasts, etc.

From Page 3, "No publication or registration or other action in the Copyright Office is required to secure copyright."  Could it be that there is no paperwork to fill out?  Or form to submit?  Download and read for yourself!

From Page 7, "In general, copyright registration is a legal formality intended to make a public record of the basic facts of a particular copyright. However, registration is not a condition of copyright protection."

From Page 4, "The use of a copyright notice is no longer required under U. S. law, although it is often beneficial. "

Seriously, folks, if you are not Copyrighting your works as you create them, you are doing you and your company a serious dis-service.  Copyrighting will not prevent people from stealing your work to claim as their own, but every step you take to protect yourself and your work will help if you ever have to take legal action.

Great advice and I just downloaded the Copyright Basics and will read through it later.  Although we have not copyrighted all of our information yet, we certainly have branded ourselves well.  We just hosted an open house event where 45 agents showed up and the common response was, "I recognize you from your marketing materials you send us AND your staging style."  That made us feel really good!  But thank you for the needed push to make sure we are protecting the successful business we have started.

Funny how things work some times:  The best part of joining a group like Active Rain is sharing information.  I post about how we should proteect ourselves and Copyright our photos.  And some one like Melissa comes along and reminds me that, (duh!) I have not Copyrighted my logos.  What was I thinking!

The sharing of information is why the internet was created, and it makes me happy that I joined A/R when I can learn from others' experiences.

Michael, thanks for all the wonderful input you have been putting out about copyrighting.  I would have never thought about copy righting my photos.  I agree its a sad day when we all have to worry about something like this.  By the way, I love your logo.  Please let us all know where you have found this wonderful site.  : )

Thanks for the link, and the heads up the read is 12 pages!  Will get to it on my second cup of coffee!  The sad stories of other's work being hijacked in so many different ways makes this post relevant to each and every one of us.

I'm always glad to hear open discussion about usage rights (as someone who makes my living entirely from photographs).

That said, as a general rule I disagree that one should 'copyright' (verb) their works.

Please believe me when I say I've been around the bend on this issue 100 times.

So why would I take such an odd position as a professional photographer?

As the current law is written my (and your) images have all applicable (legal) copyright the second they are created. They are the legal property of the owner and no one else. Period. 

If I (or others) advocate a culture of 'double copyrighting' i.e. insisting images require registration we effectively create a situation where you may NEED to register your images to protect them.

This would be a huge step backwards in terms of protecting the rights of the original author.

That's not to say there are not instances where it might make sense (life is full of exceptions, no?) - if for example, I was in the habit of licensing photos to the AP / Getty etc...I probably would register the photos in question simply to clear the way for the fastest possible legal decision should one be required.

Hi, Bryce:  I was hoping to engage some one from another corner of A/R by posting this in several places.  Thanks for your input.

I agree that mandatory registration would be a sheer bummer - who wants to do all of the paperwork required from a government entity?  It would become a full time job.

When writing this blog, I hesitated from offering any advice as far as how to copyright, etc, because I believe people should read and understand for themselves the rights they have as Creators.  And to exercise their rights when they feel they have been violated. Mainly, like you state, if you took the picture of your house,it is a picture of your creation and you are the legal owner.  Many times I feel people confuse Copyrighting with Trademarking and all of its hullabaloo.

Thanks for stopping by - what an honor to have been featured in the newsletter overnight!  I am seeing loads of traffic from all over the country on my website, and I appreciate your visits. I am honored by your interest in me and my company!

And Glen:  I can't copyright The Stage Coach name - I would have to trademark it.  Totally different and I can't afford it! The Stage Coach is registered in Travis and Williamson Counties, so you would not be able to practice under the name in these two counties with out hearing from me and my legal representatives. ;)

Actually, if you Google "Stage Coach Home Staging", you will find several throughout the country.  We seem to coexist just fine, as long as we respect each others' territory and Content! :)

Thanks for your comments above, as it is a VERY common misconception that there is some formal requirement for obtaining a copyright on a creative work.  You're correct that original works are protected by copyright law the second they're fixed into a tangible form.  This is a relatively new aspect of U.S. copyright law, as registration was required before the laws were revamped in the '70's.  However, the registration requirements are not likely to return to their former state, because the reason for the change arises out of the U.S.'s signature on several international treaties that probably aren't going anywhere.

To supplement, there are some benefits that registration of a copyright may secure, although admittedly the cost of registering every work will outweigh the potential benefits for many artists.  These benefits can include a right to claim statutory damages, a right to sue for violation of the copyright, and evidentiary presumptions in favor of the registered copyright holder.  Not all of these benefits require registration right away, and many artists will choose not to register their copyrights until a legal action arises, while others choose to register everything right away.  So, whether or not to register will depend on the particulars of a copyright holder's business and risk.

I know from my years as a technical writer/editor that there is little point in copyrighting material -- it has, by the very nature of its existence, a "right of copy". That said, it's pathetic that a person would use material belonging to someone else.
